Common use of Good Order, Condition And Repair Clause in Contracts

Good Order, Condition And Repair. Except as provided in Section 8.1 hereof, and subject to the provisions of Article 13 hereof (which shall be controlling in the event of any casualty or condemnation covered by such Article 13), Tenant at its sole cost and expense shall keep and maintain in good and sanitary order, condition and repair the Premises and every part thereof, wherever located (excluding the shared-use areas of the Service Annex, subject to Section 8.1 above, but including any and all portions of the Service Annex designated for exclusive use by the occupant of the Building), including but not limited to the signs, interior, ceiling, electrical system, plumbing system, telephone and communications systems serving the Premises, the HVAC equipment and related mechanical systems serving the Premises (for which equipment and systems Tenant shall enter into a service contract with a person or entity reasonably approved by Landlord), all doors, door checks, windows, plate glass, door fronts, exposed plumbing and sewage and other utility facilities, fixtures, lighting, wall surfaces, floor surfaces and ceiling surfaces of the Premises and all other interior repairs, foreseen and unforeseen, with respect to the Premises, as required.

Good Order, Condition And Repair. Except as provided in Section 8.1 hereof, and subject to the provisions of Article 13 hereof (which shall be controlling in the event of any casualty or condemnation covered by such Article 13), Tenant at its sole cost and expense shall keep and maintain in good and sanitary order, condition and repair the Premises and every part thereof, wherever located (excluding the shared-use areas of the Service Annex, subject to Section 8.1 above, but including any and all portions of the Service Annex designated for exclusive use by the occupant of the Building)located, including but not limited to the signs, interior, ceiling, electrical systemthe electrical, plumbing systemand sewer (within the Premises and up to the “T” junction(s) serving the Premises), telephone and communications systems serving the Premises, the HVAC equipment and related other mechanical systems and elevators (if any) serving the Premises (for which equipment equipment, systems and systems elevators Tenant shall enter into a service contract with a person or entity reasonably designated or approved by Landlord), any supplemental or auxiliary mechanical systems installed by Tenant to serve the Premises, exposed plumbing and sewage and other utility facilities, all doors, door checks, windows, plate glass, door fronts, exposed plumbing and sewage and other utility facilitiesfixtures, fixturespartitions, lighting, wall surfaces, floor surfaces and coverings and ceiling surfaces and coverings of the Premises Premises, and all other interior repairs, foreseen and unforeseen, with respect to the Premises, as required.

Except as provided in -------------------------------- Section 8.1 10.1 hereof, and subject to the provisions of Article 13 hereof except for damage caused by Landlord or its agents, employees or contractors (which shall be controlling the sole responsibility of Landlord, subject to the release set forth in the Section 12.4 hereof) or by an event of any casualty or condemnation covered (which shall be governed by such Article 1315 hereof), Tenant at its sole cost and expense shall keep and maintain in good and sanitary order, condition and repair the Premises and every part thereof, wherever located (excluding the shared-use areas of the Service Annex, subject to Section 8.1 above, but including any and all portions of the Service Annex designated for exclusive use by the occupant of the Building)located, including but not limited to the signs, interior, ceiling, electrical system, plumbing system, telephone and communications systems serving of the Premisesbuildings in which the Premises are located, the HVAC equipment and related mechanical systems serving the Premises (for which equipment and systems Tenant shall enter into a service contract with a person or entity reasonably designated or approved by Landlord), all doors, door checks, windows, plate glass, door fronts, exposed plumbing and sewage and other utility facilities, fixtures, lighting, wall surfaces, floor surfaces and ceiling surfaces of the Premises and all other interior repairs, foreseen and unforeseen, with respect to the Premises, as required.

Good Order, Condition And Repair. By accepting possession of the Premises. Tenant acknowledges that the Premises are in good and sanitary order, condition and repair, subject only to any "punch list" procedures and any express warranties set forth in Article 5 and/or Exhibit C hereof. Except as provided in Section 8.1 10.1 hereof, and subject to the provisions of Article 13 hereof (which shall be controlling in the event of any casualty or condemnation covered by such Article 13), Tenant at its sole cost and expense shall keep and maintain in good and sanitary order, condition and repair the Premises and every part thereof, wherever located (excluding the shared-use areas of the Service Annex, subject to Section 8.1 above, but including any and all portions of the Service Annex designated for exclusive use by the occupant of the Building)located, including but not limited to the roof (non-structural portions only, and only during any period when the Premises constitute the entire Building), signs, interior, ceiling, electrical system, plumbing system, telephone and communications systems serving the Premises, the HVAC equipment and related mechanical systems serving the Premises (for which equipment and systems Tenant shall enter into a service contract with a person or entity reasonably designated or approved by Landlord), all doors, door checks, windows, plate glass, door fronts, exposed plumbing and sewage and other utility facilities, fixtures, lighting, wall surfaces, floor surfaces and ceiling surfaces of the Premises and all other interior repairs, foreseen and unforeseen, with respect to the Premises, as required.

Good Order, Condition And Repair. Subject to the provisions of Section 2.4 hereof, by accepting possession of the Premises (excluding any portion thereof in which interior improvements have not been completed as a result of the phased construction of such interior improvements) on the Commencement Date, Tenant shall be deemed to acknowledge that the Premises (or the applicable initial portion thereof) are then in good and sanitary order, condition and repair.
