GOVERNMENT AGRICULTURAL PROGRAM PAYMENTS. X. Xxxxx agrees to continue to honor any existing government agricultural program contracts affecting the Property, and agrees to indemnify and hold harmless Seller for any damage Seller may sustain by reason of any failure of Buyer to keep or perform any of the covenants and obligations provided to be kept or performed under the terms and conditions of any such contracts by Seller.

GOVERNMENT AGRICULTURAL PROGRAM PAYMENTS. A. Seller___/Buyer___ shall receive the landowner share of ARC/PLC government program payments for the crop year. Seller___/Buyer_X__ shall receive the landowner share of government program payments for the 2021 crop year. Current Tenant_X_/ shall receive the landowner share of government program payments for the 2020 crop year.
GOVERNMENT AGRICULTURAL PROGRAM PAYMENTS. XXXXX accepts title subject to the farm’s existing participation in the following government agricultural programs (check appropriate statements): Conservation Reserve Program (CRP) Conservation Reserve Enhancement Program (CREP) Average Crop Revenue Election Program (ACRE) Other (specify) The SELLER shall receive the landowner share of government program payments and conservation program payments for the 2023 crop year. The SELLER grants to the BUYER the right to inspect and obtain a copy at BUYER’S expense of all records in relation to the Property which are on file at the United States Department of Agriculture, Farm Service Agencies Office in the County where the records for said Property are maintained. If necessary, SELLER and BUYER agree to execute any and all documents to transfer SELLER’S interest in the Government Programs with respect to the property to BUYER. The BUYER will assume all rights, responsibilities and legal obligations for any program contracts, including any fees or penalties assessed thereunder, should they wish to remove land from the program. The BUYER is personally responsible for the repayment of any benefits received by the SELLER in any year and which repayment obligation of SELLER is caused by actions taken by BUYER after closing. The SELLER and the BUYER each acknowledge that they are familiar with the Conservation Reserve Program (CRP) and the manner in which it is administered by the Farm Service Agency of the United States Department of Agriculture. This Agreement shall survive the closing.
