Government Audit; Investigations. Provider acknowledges and agrees that the Department, the Office of Inspector General, the Comptroller General, the U.S. Department of Health and Human Services (DHHS) and the Centers for Medicare and Medicaid Services (CMS) or their authorized representatives or their designees shall have the right to inspect or otherwise evaluate the quality, appropriateness, and timeliness of services provided under the terms of the applicable State Contract and any other applicable rules, including the right to inspect and audit any records or documents of Provider and its subcontractors, and the right to inspect the premises, physical facilities, and equipment where Medicaid-related activities or work is conducted. The right to audit under this section exists for 10 years from the end date of the State Contract or from the date of completion of any audit, whichever is later. There shall be no restrictions on the right of the State or federal government to conduct whatever inspections and audits are necessary to assure quality, appropriateness or timeliness of services provided pursuant to the State Contract and the reasonableness of their costs.
