GOVERNMENT OR UTILITY CHARGES. The Home Owner will be responsible for payment of any and all government or utility chargesplus maintenance and administrative costs as defined in this prospectus, by Chapter 723, Florida Statutes, or by Florida law. Such charges are considered additional rent. These charges will be assessed to the Home Owner based on actual usage which may be determined by meter or other measurement, on a pro rata basis or other equitable apportionment, by a method reasonably intended to encourage conservation, based on the benefit conferred on the Home Owner, or by any combination thereof. "Pro rata" means that percentage derived by dividing the number of manufactured home spaces leased by a Home Owner by the total number of occupied manufactured home spaces in the Park. The dollar amounts set above represent only the amounts charged for each rental category on the Delivery Date. As disclosed in this Prospectus, such amounts are subject to increase. Wherever "O" appears above a blank for the amount charged for any rental category described above, it means that charges for that rental category are not imposed by the Association on the Delivery Date. The amount of those charges may be increased as described in this Prospectus. Nothing in this Rental Agreement shall be deemed a waiver of the owners' right to collect from the mobile home owner any damages that the owners may sustain as a result of or in connection with a tortious act, neglect or breach of lease by the mobile home owner or anyone permitted to be on Park property by the mobile home owner.

  • GOVERNMENT REQUIREMENTS The Union and the Employer recognize that an Employer should not lose jobs because of government requirements which conflict with the provisions of this Agreement the Union and the Employer pledge their mutual cooperation in complying with provisions in any contract which the Employer may bid for or enter into with any public or quasi-public or governmental body for the performance of work covered by this Agreement. If the Employer believes that a government requirement conflicts with the Agreement, they shall request a pre-job meeting with the Union to seek alternatives. The Union will not withhold agreement unnecessarily.

  • Government Use If the Software, Documentation, Materials and any other Licensor services are being or have been acquired with U.S. Federal Government funds, or Customer is an agency, department, or other entity of the United States Government ("Government"), the use, duplication, reproduction, release, modification, disclosure, or transfer of the Software or any related documentation of any kind, including technical data, manuals or Materials, is restricted in accordance with Federal Acquisition Regulation 12.212 for civilian agencies and Defense Federal Acquisition Regulation Supplement 227.7202 for military agencies. The Software, Materials, and any Licensor services are COMMERCIAL ITEMS AS DEFINED BY THE FEDERAL ACQUISITION REGULATION. Use of the Software and Materials by the Government is further restricted according to the Agreement and any amendment hereto.

  • Government Permits The Company and its subsidiaries possess such certificates, authorities or permits issued by the appropriate state, federal or foreign regulatory agencies or bodies necessary to conduct the business now operated by them, other than those which the failure to possess or own would not have, individually or in the aggregate, a Company MAE. Neither the Company nor any of its subsidiaries has received any notice of proceedings relating to the revocation or modification of any such certificate, authority or permit which, individually or in the aggregate, if the subject of an unfavorable decision, ruling or finding, would result in a Company MAE.
