Governmental Approvals for Facility. Seller shall obtain, at its expense, any and all Governmental Approvals required for the construction, ownership, operation and maintenance of the Facility and the interconnection of the Facility to the Company System. Under no circumstancecircumstances shall Seller commence any construction, operation or maintenance of the Facility or interconnection of the Facility to the Company System, without first obtaining the required, applicable Governmental Approvals. No later than the applicable Partial In-Service Date, Seller shall obtain all Governmental Approvals necessary for the ownership, operation and maintenance of the corresponding Partial Installation and shall satisfy any condition or requirement set forth in any such Governmental Approvals for the ownership, operation and maintenance of such Partial Installation (excluding on-going reporting or monitoring requirements that may continue beyond the applicable Partial In-Service Date in accordance with such Governmental Approval). No later than the Commercial Operations Date, Seller shall obtain all other Governmental Approvals necessary for the ownership, operation and maintenance of the Facility and shall satisfy any condition or requirement set forth in any such Governmental Approvals for the ownership, operation and maintenance of the Facility (excluding on-going reporting or monitoring requirements that may continue beyond the Commercial Operations Date in accordance with such Governmental Approval).

Governmental Approvals for Facility. Subscriber Organization shall obtain, at its expense, any and all Governmental Approvals required for the construction, ownership, operation and maintenance of the Facility and the interconnection of the Facility to the Company System. Under no circumstance shall Subscriber Organization commence any construction, operation or maintenance of the Facility or interconnection of the Facility to the Company System, without first obtaining the required, applicable Governmental Approvals.
