GRANT OF ENCROACHMENT Sample Clauses

GRANT OF ENCROACHMENT. For the sum of Ten and no/100ths ($10.00) Dollar, the sufficiency and receipt of which is hereby acknowledged, the City, its successors and assigns, does agree that Xxxxxxxx, their heirs, successors and assigns, may encroach on the City’s property, but only within the Encroachment Area, and subject to the terms and conditions of this Agreement. Said encroachment cannot be enlarged upon or changed to any other use, other than for use as described herein. The City grants such encroachment to Xxxxxxxx, AS-IS, WHERE IS, without any representation or warranty by the City, including without limitation, any representation or warranty as to title to the Encroachment Area, the physical condition of the Encroachment Area, or the suitability of the Encroachment Area for Xxxxxxxx use thereof pursuant to this Agreement.

GRANT OF ENCROACHMENT. City covenants and agrees that: a) Liberty shall have the right to construct the Walkway so that it encroaches upon the Easement; b) so long as the Walkway shall remain standing, Liberty shall have the right to have the Walkway encroach upon the Easement; and c) Liberty shall have the right to use the Walkway for pedestrian travel.

GRANT OF ENCROACHMENT. 2.1 For the sum of Ten and no/100ths ($10.00) Dollars, the sufficiency and receipt of which is hereby acknowledged, the Grantor, does covenant and agree that the Grantee may encroach on the Grantor’s property, but only within the Encroachment Area, and subject to the terms and conditions of this Agreement. Said encroachment cannot be enlarged upon or changed to any other use, other than the Fence and landscaping.

The City grants such encroachment to Germans, AS-IS, WHERE IS, without any representation or warranty by the City, including without limitation, any representation or warranty as to title to the Encroachment Area, the physical condition of the Encroachment Area, or the suitability of the Encroachment Area for Xxxxxxxx'x use thereof pursuant to this Agreement.

Said encroachment cannot be enlarged upon or changed to any other use, other than for use as described herein. The City grants such encroachment to New Old, AS-IS, WHERE IS, without any representation or warranty by the City, including without limitation, any representation or warranty as to title to the Encroachment Area, the physical condition of the Encroachment Area, or the suitability of the Encroachment Area for New Old use thereof pursuant to this Agreement.

GRANT OF ENCROACHMENT. CITY hereby grants to RIVER WALK a durable right of encroachment upon the PUBLIC PARK, for the purpose of constructing, installing, maintaining, and operating the IMPROVEMENTS (defined below), subject to the limitations set forth herein and RIVER WALK’s fulfillment and ongoing compliance with the terms and conditions set forth herein. The installation and maintenance of, and any use of, the IMPROVEMENTS (defined below) shall be subordinate to any use and operations which CITY may conduct during the effective period of this AGREEMENT, and RIVER WALK shall not cause any unreasonable delay or interference with CITY’S access to the PUBLIC PARK. RIVER WALK shall not interfere with the operations of CITY in the PUBLIC PARK, whether or not such interference is considered material.

GRANT OF ENCROACHMENT. The Municipality hereby permits the Encroachment to exist upon the Road/Road Allowance in the manner and location as is shown in red on the attached map which is attached hereto as Schedule “A” to this Agreement, subject to the terms, covenants and conditions contained within this Agreement.

GRANT OF ENCROACHMENT. CITY hereby grants to APPLICANT a right of encroachment upon the PUBLIC RIGHT-OF-WAY, for the purpose of constructing, installing, maintaining, and operating the IMPROVEMENTS (defined below), subject to the limitations set forth herein and APPLICANT ’s fulfillment and ongoing compliance with the terms and conditions set forth herein. The installation and maintenance of, and any use of, the IMPROVEMENTS (defined below) shall be subordinate to any use and operations which CITY may conduct during the effective period of this AGREEMENT, and APPLICANT shall not cause any unreasonable delay or interference with CITY’S access to the PUBLIC RIGHT-OF-WAY. APPLICANT shall not interfere with the operations of CITY in the PUBLIC RIGHT-OF-WAY, whether or not such interference is considered material.

GRANT OF ENCROACHMENT. 2.1 For the sum of Ten and no/100ths ($10.00) Dollars, the sufficiency and receipt of which is hereby acknowledged, the Grantor, does covenant and agree that the Grantee may encroach on the Grantor’s property, but only within the Encroachment Area, and subject to the terms and conditions of this Agreement. Said encroachment cannot be enlarged upon or changed to any other use, other than the concrete path, retaining wall, and paver patio. 2.2 Grantor hereby reserves the right to revoke this agreement in its sole discretion should such removal be deemed in the best interest of the general public.

GRANT OF ENCROACHMENT. The Owner hereby permits the Encroachment to exist upon the Owner's Land in the manner and location as is shown in red on the Surveyor Sketch which is attached hereto as Schedule "A" to this Agreement, subject to the terms, covenants and conditions contained within this Agreement.
