Common use of Hardware Upgrades and Updates Clause in Contracts

Hardware Upgrades and Updates. Software updates and upgrades may require hardware updates or upgrades. Unless included hereunder, Customer is responsible for any such hardware updates or upgrades. If included in the quotation, Philips will provide one commercially available computer hardware upgrade during the term of the Agreement, to the Covered System hardware component(s) expressly described on the quotation under the Technology Maximizer option. Philips will provide such hardware upgrade at the time and quantity as expressly described on the quotation under the Technology Maximizer option. In no case will Philips obligation under any Covered System hardware provided under the Agreement exceed $5,000 or the amount expressly described on the quotation under the Technology Maximizer option, whichever is greater. This paragraph (b) does not apply if the software only Technology Maximizer option.
