System Upgrades. The Connecting Transmission Owner shall procure, construct, install, and own the System Upgrade Facilities and System Deliverability Upgrades described in Attachment 6 of this Agreement. To the extent that design work is necessary in addition to that already accomplished in the Class Year Interconnection Facilities Study for the Interconnection Customer, the Connecting Transmission Owner shall perform or cause to be performed such work. If all the Parties agree, the Interconnection Customer may construct System Upgrade Facilities and System Deliverability Upgrades.
System Upgrades. The treatment of system upgrades associated with requests for interconnection of generating facilities to the CAISO Controlled Grid shall be in accordance with the provisions of the CAISO Tariff. A Participating TO shall be entitled to require an entity requesting interconnection of a transmission facility or load to the CAISO Controlled Grid to pay for all necessary system reliability upgrades on its side of the interconnection and on the CAISO Controlled Grid, as well as for all required studies, inspection, and testing, to the extent permitted by FERC policy. The entity requesting such an interconnection shall be required to execute an interconnection agreement in accordance with the CAISO Tariff and the TO Tariff as applicable, provided that the terms of the CAISO Tariff shall govern to the extent there is any inconsistency between the CAISO Tariff and the TO Tariff, and must comply with all of their provisions, including provisions related to creditworthiness and payment for interconnection studies.
System Upgrades. The Connecting Transmission Owner shall procure, construct, install, and own the System Upgrade Facilities and System Deliverability Upgrades described in Attachment 6 of this Agreement. To the extent that design work is necessary in addition to that already accomplished in the Class Year facilities study for the Interconnection Customer, the Connecting Transmission Owner shall perform or cause to be performed such work. If all the Parties agree, the Interconnection Customer or Niagara Wind Power may construct System Upgrade Facilities and System Deliverability Upgrades that are located on land owned by the Interconnection Customer or Niagara Wind Power.
System Upgrades. The Public Utility will design, procure, construct, install, and own any System Upgrades under the process prescribed in the Commission’s rules, ARSD chapter 20:10:36. The actual cost of the System Upgrades, including overheads, will be directly assigned to the Applicant. An Interconnection Customer may be entitled to financial compensation from other utility Interconnection Customers who, in the future, benefit from the System Upgrades paid for by the Interconnection Customer. Such compensation will be governed by separate rules promulgated by the Commission or by terms of a tariff filed and approved by the Commission. Such compensation will only be available to the extent provided for in the separate rules or tariff.
System Upgrades. Enova may change the design of the Panther Drive System from time to time and, at its sole discretion, provide upgraded parts, including without limitation hardware, firmware and software, for the Panther Drive Systems (collectively, "Upgrades") shipped to Purchaser but which have not yet been incorporated in Products and shipped to an end user. In the event Enova decides to provide such an Upgrade, Enova will notify Purchaser of the Upgrade, and Enova and Purchaser will mutually agree upon a time for the Upgrade to be installed and the party or parties who will do the installation.
System Upgrades. No Provider shall be required to purchase, upgrade, enhance or otherwise modify any Systems used by any Recipient as of the date hereof in connection with the business of any Party, or to provide any support or maintenance services for any Systems that have been upgraded, enhanced or otherwise modified from the Systems that are used in connection with the business of any Party as of the date hereof.
System Upgrades. Upgrades or installation of missing parts to any of your systems are not included in the cost of your service contract. We may, if recommended by our engineer, supply you with a fixed price repair and if you choose to accept, the full repair cost must be paid before any works are carried out. Examples of upgrades are:

System Upgrades. As a result of the analysis described in section 1.4, the Utility will provide the Customer with a cost estimate and projected timeframe for any distribution system upgrades that may be necessary to accommodate the generating facility.
System Upgrades. HEA shall design, procure, construct, install, and own the system upgrades described in Attachment 5 of this Agreement. If HEA and the Interconnection Customer agree, the Interconnection Customer may construct system upgrades that are located on land owned by the Interconnection Customer. The actual cost of the system upgrades, including overheads, shall be directly assigned to the Interconnection Customer.
