Upgrades. If this copy of the Software is an upgrade from an earlier version of the Software, it is provided to you on a license exchange basis. You agree by your installation and use of such copy of the Software to voluntarily terminate your earlier XXXX and that you will not continue to use the earlier version of the Software or transfer it to another person or entity unless such transfer is pursuant to Section 3.
Upgrades. To use upgrade software, you must first be licensed for the software that is eligible for the upgrade. Upon upgrade, this agreement takes the place of the agreement for the software you upgraded from. After you upgrade, you may no longer use the software you upgraded from.
Upgrades. The Software includes all updates or supplements to the Software and this Section 19 applies to all such updates or supplements, unless the BNPP Entities provide other terms along with the update or supplement.
Upgrades. If the SOFTWARE PRODUCT is labeled as an upgrade, you must be properly licensed to use a product identified by Software FX as being eligible for the upgrade in order to use the SOFTWARE PRODUCT. A SOFTWARE PRODUCT labeled as an upgrade replaces and/or supplements the product that formed the basis for your eligibility for the upgrade. You may use the resulting upgrading product only in accordance with the terms of this License Agreement. If the SOFTWARE PRODUCT is an upgrade of a component of a package of software programs that you licensed as a single product, the SOFTWARE PRODUCT may be used and transferred only as part of that single package and may not be separated for use in more than one computer.
Upgrades. (a) Licensor may, from time to time and at its discretion, provide generally available new versions of Software to Licensee through Licensor’s web site at xxx.xxxxxxxxx.xxx.
(b) If not agreed otherwise in writing between Licensor and Licensee, upon upgrading to new version of Software the relationship between parties shall be governed and amended (if applicable) by the terms and conditions of License agreement related to Software available at xxx.xxxxxxxxx.xxx on the day of upgrade download.
Upgrades. Notwithstanding any other terms in this Agreement, if the Software is licensed as an upgrade or update, then the latest update or upgrade that you download and install replaces the Software previously licensed. You agree that the upgrade or update and the associated license keys does not constitute the granting of a second license to the Software (i.e., you may not use the upgrade or update in addition to the Software it is replacing and whose license has terminated).
Upgrades. 9.1 If Licensee’s use of Software falls under paragraph (i) of section 4(a), Licensor will provide all generally available Software Upgrades to Licensee free of charge until termination of this Agreement as set forth in section 13.
9.2 If Licensee has obtained User Pack, Licensor will provide all generally available Software Upgrades to Licensee free of charge during a 1-year period following the User Pack purchase (“Upgrade Subscription”). Licensee may renew Upgrade Subscription for another 1-year period as set forth on Licensor’s web site. Each subsequent Upgrade Subscription term will start on the day following expiration of the previous Upgrade Subscription term regardless of the actual Upgrade Subscription renewal date. If Licensee elects not to renew Upgrade Subscription, Licensee would retain perpetual right to continue using the most recent version of Software released by Licensor during applicable Upgrade Subscription term, subject to restrictions set forth in clause 4. This section 9.2 is not applicable to Classroom Licenses and OS-Project Licenses which are subject to section 5 (d).
9.3 Upon installing any Upgrade, Licensee shall cease using any previous License Key of Software.
Upgrades. From time to time, an upgrade to the latest version of the Client Software may be required in order to access and/or make transactions on BlackBerry App World through the Client Software.
Upgrades. Each of the non-Enterprise Studio products - Essential® Studio – UI Edition (Source or Binary) - Essential® Studio – Reporting Edition (Source or Binary) - Essential® Studio – BI Edition (Source or Binary) can be upgraded to Essential® Studio – Enterprise Edition (Source or Binary). This upgrade is referred to as Essential® Studio – Enterprise Edition – Upgrade (Source or Binary). Each of the individual Essential® products (as set forth in the table below) can be upgraded to the non-Enterprise Studio product that it is bundled with. These upgrades are referred to as: - Essential® Studio – UI Edition – Upgrade (Source or Binary) - Essential® Studio – Reporting Edition – Upgrade (Source or Binary) - Essential® Studio – BI Edition – Upgrade (Source or Binary) • Note that Test Studio is currently included only with the full Essential® Studio Enterprise Edition, and is not available as a standalone product or with any other Edition. Upgrades. Software Versions or maintenance updates, if available, may be ordered separately or may be available through Software support. We reserve the right to require additional licenses and fees for Software Versions or separately purchased maintenance updates or for Use of the Software in conjunction with upgraded hardware or Software. When you obtain a license for a new Software Version, your Software License for the earlier Version will terminate. Software Versions are subject to the license terms in effect on the date that we deliver or make the Version available to you.
