Common use of Harvest Share Use Clause in Contracts

Harvest Share Use. Only Members that notify the Manager in writing on or before 16 April 15 2014 (the “Notification Date”), and on or before any succeeding Notification Dates established 17 by the Board for FY 2014 and thereafter of their intention to harvest Sector ACE (“Active Members”) 18 may harvest Sector ACE. Each Member’s notice that such Member intends to harvest Sector ACE shall 19 identify the vessels which will be used for such harvest. Non-Active Members shall not harvest Xxxxxx 00 ACE, including without limitation, their own Harvest Share. No Active Member shall harvest an amount 21 of Sector ACE in excess of their Harvest Share. Harvest of each Active Member’s Harvest Share shall be 22 subject to all NMFS and other management regulations generally applicable to the Sector’s ACE 23 (including but not limited to seasonal apportionments and area harvest restrictions) on a discreet, 24 individual basis; i.e., no greater percentage of each Member's Harvest Share may be harvested in any 25 season or area than the percentage of the related Sector ACE allocation permitted to be harvested in 26 such season or area. The Manager may impose and enforce additional restrictions on each Active 27 Member’s harvest of Sector ACE authorized by this Agreement or adopted by the Board.

Harvest of each Active Member’s Harvest Share shall be 22 23 subject to all NMFS and other management regulations generally applicable to the Sector’s ACE 23 24 (including but not limited to seasonal apportionments and area harvest restrictions) on a discreet, 24 25 individual basis; i.e., no greater percentage of each Member's Harvest Share may be harvested in any 25 26 season or area than the percentage of the related Sector ACE allocation permitted to be harvested in 26 27 such season or area. The Manager may impose and enforce additional restrictions on each Active 27 28 Member’s harvest of Sector ACE authorized by this Agreement or adopted by the Board.
