Common use of Hazardous Duty Clause in Contracts

Hazardous Duty. No bargaining unit Employee, without his/ her express permission, shall be required to work or come in contact with, or be in unreasonable proximity to, any hazardous liquid, chemical, gas, explosives, radioactive material, or vapor, unless the presence or use of such liquid, chemical, gas, explosives, radioactive material, or vapor is normal in the performance of his/her duties. The Employer shall provide Employees with proper training and information on hazardous material and the risks of injury from hostile clients or residents.
