Class Action Grievance. Grievances that allege the same violation(s) of the Agreement (inclusive of its Appendices), seeks the same remedy and involve more than one grievant shall, at the union’s request, be submitted at STEP 2 as a Class Action Grievance.
Class Action Grievance. A grievance which affects a group or class of employees or is an alleged violation of this Agreement with respect to the rights and/or privileges granted the Association. To qualify as a Class Action Grievance, the grievance must include the signature of the NBEA President or designee.
Class Action Grievance. A grievance covering more than one employee must be identified as a “class action grievance” when first submitted. The scope of the grievance shall then be described; and, to the extent reasonably known by the Union, the employees shall be identified by name. A “class action grievance” must meet the definition of a grievance, as described in 21.1 of this Article, to be processed as such.
Class Action Grievance. 12.6 Immediate Arbitration
Class Action Grievance seeking specific relief for more than one (1) member may be filed by the Association on behalf of all affected members. The identity of those individual members allegedly affected will be disclosed to the administration no later than Level III.
Class Action Grievance. A grievance where circumstances are substantially the same for two (2) or more employees. In cases which are termed "class action," the individual asserting the grievance or Union shall represent the other affected employees.
Class Action Grievance. A class action grievance shall be discussed within twenty (20) days of the event leading to the grievance with the Assistant Superintendent of Human Resources. The Association shall provide the names of all schools and all teachers who are affected by the subject of the class action grievance. In order for a class action to proceed, the Association must identify at least one bargaining unit member at each of at least two different schools. The Association’s list of teachers affected by the subject of the grievance may be amended at any time during the grievance process to add or delete bargaining unit members.
Class Action Grievance. A class action grievance shall mean an allegation resulting in a dispute or disagreement between the employer and employee effecting more than one employee, including violation, interpretation, or application of specific articles and sections of this agreement. The Union shall present the grievance at Step III to the Support Services Division head.
Class Action Grievance. A CLASS ACTION GRIEVANCE shall be defined as a grievance that affects more than one employee in the bargaining unit.
Class Action Grievance. A class action grievance may be filed by the Association if a class or group of teachers is affected by the grievance, and the matter is one that cannot be resolved by the teachers’ immediate supervisor. The Association may submit such grievance in writing to the Superintendent, identifying the teachers for whom the grievance is brought, and the processing of such grievance shall be commenced at Step Three.
