Common use of Head of the Household Clause in Contracts

Head of the Household. The adult member of the family who is considered the head for purposes of determining income eligibility and rent. However, the income of the head of household, co-head, and each additional family member is included in determining rent. The head of household is responsible for ensuring that the family fulfills all of its responsibilities under the program, alone or in conjunction with a co-head or spouse. 24 CFR 5.504(b) a. The family may designate any qualified family member as the head of household. b. The head of household must have the legal capacity to enter into a lease under state and local law. A minor who is emancipated under state law may be designated as head of household. c. Final approval of the head of household is based on the person passing CHA’s screening requirements.
