- Headings, Gender, Tense and Number. The Table of Contents and Article headings of this Lease are included for convenience only, and shall not limit or define the meaning or content hereof. All pronouns and any variations thereof shall be deemed to refer to the masculine, feminine, neuter, singular or plural, as the identity of the person or persons may require. Unless the context otherwise requires, the singular includes the plural and vice versa. The terms "herein," "hereof" and "hereunder," and words of similar import, shall be construed to refer to this Lease as a whole, and not to any particular Article or Section, unless expressly so stated. The term "person" shall mean any natural person or persons, a Partnership, a corporation, a limited liability company a trust, and any other form of business or legal association or entity, unless expressly otherwise stated. An "Affiliate" of Tenant shall mean any person, firm or corporation which controls or is controlled by, or is under common control with, Tenant, with the word "control" (and, correspondingly, "controlled by" and "under common control with"), as used with respect to any person, meaning the possession of the power to direct or cause the direction of the management and policies of such person. An "Affiliate" of Landlord shall mean any person, firm or corporation which controls or is controlled by, or is under common control with Landlord or is controlled by any one (1) or more of the principals of Landlord.

Unless otherwise expressly indicated, all references herein to “Article,” “Section,” “Schedule” or “Exhibit” shall mean articles and sections of, and schedules and exhibits to, this Agreement.

  • Captions and Gender The captions in this Agreement are for convenience only and shall not affect the construction or interpretation of any term or provision hereof. The use in this Agreement of the masculine pronoun in reference to a party hereto shall be deemed to include the feminine or neuter, as the context may require.
