Common use of Historical Performance Information Clause in Contracts

Historical Performance Information. To the extent agreed upon by the parties, the Sub-SubAdviser will provide the Fund and the SubAdviser with historical performance information with respect to Sub-SubAdviser’s similarly managed investment companies or other accounts, to be included in the Prospectus or for any other uses permitted by applicable law and to the extent available.

To the extent agreed upon by the parties, the Sub-SubAdviser will provide the Fund and the SubAdviser with historical performance performance, fee and expense information with respect to about the composite of accounts and investment companies the Sub-SubAdviser’s similarly managed SubAdviser manages that have investment companies or other accountsobjectives, policies, and strategies substantially similar to those employed by the Sub-SubAdviser in managing the Allocated Assets, to be included in the Prospectus or for any other uses permitted by applicable law or to permit the Adviser and SubAdviser to the extent availablesatisfy their supervision and oversight responsibilities.
