Common use of HOSTAGE/INTERNMENT Clause in Contracts

HOSTAGE/INTERNMENT. Unless he has been found guilty of a criminal act or negligence, a Cabin Attendant who, while engaged in Company business, becomes interned or is reported missing, or is held hostage, will be entitled to his regular salary, which will be the greater of his average monthly salary over the preceding 3 month period or the equivalent of 75 hours calculated at his hourly rate of pay. This monthly compensation will be credited to the Cabin Attendant's account and will be disbursed in accordance with written instructions from the Cabin Attendant, as indicated in Appendix A. Each Cabin Attendant will issue such instructions using this form. A Cabin Attendant will not lose any pay as a result of the unlawful seizure of any aircraft to which he was assigned on either an operational or deadhead basis. Notwithstanding the foregoing, a Cabin Attendant will also be entitled to any claim arising from WSIB, CSST and WCB legislation.
