Identity of Individuals. Data Recipient agrees not to use the Data in such a way as to identify any individual and further agrees not to contact any individual who may be a subject within the Data.
Identity of Individuals. NSK will provide Settlement Class Counsel with the identity of all current and former employees, directors and officers of NSK who: (1) were interviewed by the DOJ, JFTC, or EU in connection with alleged anticompetitive activity; or (2) appeared before the grand jury in the DOJ investigation of conduct in the Bearings and/or Electronic Powered Steering Assemblies industries.
Identity of Individuals. At the request of End-Payor Plaintiffs, following Preliminary Approval, counsel for NGK shall provide Settlement Class Counsel with the identity of all current and former employees, directors and officers of NGK who: (1) were interviewed and/or prosecuted by any Government Entity in connection with alleged price-fixing, bid rigging and market allocation of Spark Plugs, Standard Oxygen Sensors, and Air Fuel Ratio Sensors, provided, however, that NGK shall not be required to disclose to End-Payor Plaintiffs or Settlement Class Counsel the specific Government Entity or Government Entities by which each such current or former employee, director or officer of NGK was interviewed and/or prosecuted;
Identity of Individuals. LEONI will provide Settlement Class Counsel with the identity of all current and former employees, directors and officers of XXXXX who: (1) were interviewed by the Department of Justice (“DOJ”), the Japanese Fair Trade Commission, or the European Commission in connection with alleged anticompetitive activity; or (2) appeared before the grand jury in the DOJ investigation of the wire harness conspiracy.
Identity of Individuals. OAE will provide Settlement Class Counsel with the identity of all current and former employees, directors and officers of OAE who: (1) were interviewed by the DOJ, JFTC, or EU in connection with to be alleged anticompetitive activity; or (2) appeared before the grand jury in the DOJ investigation of the Power Window Switches conspiracy.
Identity of Individuals. TOKAI RIKA will provide Settlement Class Counsel with the identity of all current and former employees, directors and officers of TOKAI RIKA who: (1) were interviewed by the DOJ, JFTC, or EU in connection with alleged anticompetitive activity with respect to Automotive Wire Harness Systems in the United States or for vehicles that were sold in the United States; or (2) appeared before the grand jury in the DOJ investigation into alleged antitrust violations with respect to Automotive Wire Harness Systems. Neither TOKAI RIKA nor Counsel for Tokai Rika shall be required to disclose to Settlement Class Counsel the specific Government Entities to which each such current or former employee, director or officer of TOKAI RIKA was identified or appeared before.
Identity of Individuals. VALEO will provide Settlement Class Counsel with the identity of all current and former employees, directors and officers of VALEO who: (1) were interviewed by the DOJ, JFTC, or EU in connection with the alleged anticompetitive activity relating to Air Conditioning Systems; or (2) appeared before the grand jury in the DOJ investigation of conduct in the alleged Air Conditioning Systems conspiracy.
Identity of Individuals. Within fifteen (15) business days of Settlement Class Counsel’s request, Counsel for Bosch shall provide Settlement Class Counsel with the identity of all current and former employees, directors and officers of Bosch who: (1) were interviewed and/or prosecuted by any Government Entity in connection with alleged price-fixing, bid rigging, and market allocation of Hydraulic Braking Systems and/or Electronic Braking Systems; (2) appeared before the grand jury in the DOJ’s investigation into alleged antitrust violations with respect to Hydraulic Braking Systems and/or Electronic Braking Systems; and/or (3) Bosch knows were disclosed to the DOJ as having knowledge of information relating to the DOJ’s investigation into alleged antitrust violations with respect to Hydraulic Braking Systems and/or Electronic Braking Systems.
Identity of Individuals. Within fifteen (15) business days of the Execution Date of this Agreement, counsel for HIAMS shall provide Settlement Class Counsel with the identity of all current and former employees, directors and officers of HIAMS who: (a) were interviewed and/or prosecuted by any Government Entities in connection with alleged price- fixing, bid rigging and market allocation of Shock Absorbers; (b) appeared before the grand jury in the DOJ’s investigation into alleged antitrust violations with respect to Shock Absorbers; and/or (c) were disclosed to the DOJ as having knowledge or information relating to the DOJ’s investigation into alleged antitrust violations with respect to Shock Absorbers.
Identity of Individuals. Within fifteen (15) days of Settlement Class Counsel’s request, Counsel for Showa shall provide Settlement Class Counsel with the identity of all current and former employees, directors and officers of Showa who: (1) were interviewed and/or prosecuted by any Government Entity in connection with alleged price-fixing, bid rigging and market allocation of Relevant Products; (2) appeared before the grand jury in the DOJ’s investigation into alleged antitrust violations with respect to Relevant Products; and/or (3) were disclosed by Xxxxx to the DOJ as having knowledge or information relating to the DOJ’s investigation into alleged antitrust violations with respect to Relevant Products.
