Immediate Notice. The School shall immediately notify the Commission (and other appropriate authorities) of any of the following: (a) Any circumstance requiring the closure of the School, including, but not limited to, a natural disaster, such as an earthquake, storm, tsunami, flood or other weather related event, other extraordinary emergency or destruction of or damage to the School facility; (b) Any condition that may cause the School to vary from the terms of this Contract or applicable requirements, federal and/or State law; (c) The arrest of any members of the School Governing Board or School employees for a crime punishable as a felony or any crime related to the misappropriation of funds or theft; (d) Misappropriation of funds; (e) Any complaint, citation or default filed against the School by a government agency or lessor; (f) Any inaccuracy found in enrollment count or other data provided to the Commission; (g) The School receives a notice or is otherwise informed that the School or Commission is a party to a legal suit; (h) The discipline of employees at the School arising from misconduct or behavior that may have resulted in harm to students or others, or that constituted violations of law; (i) A default on any obligation, which shall include debts for which payments are past due by ninety (90) days or more; or (j) The School's enrollment at any time decreases by 10% or more compared to the most recent pupil count submitted to the Commission.
