IMPLEADER. Supplier shall not implead or bring an action against Company or its customers or the employees of either based on any claim by any person for personal injury or death to an employee of Company or its affiliates or their respective customers occurring in the course or scope of employment and that arises out of Material or services furnished under this Agreement.
IMPLEADER. Based on this clause, and if deemed as necessary, any of the Parties may implead the other Party in any type of proceedings brought against it.
IMPLEADER. SUPPLIER shall not implead or bring an action against LUCENT and its customers or the employees of either, based on any claim by any person for personal injury or death that occurs in the course or scope of employment of such person by LUCENT and its customers and that arises out of PRODUCT or services furnished by SUPPLIER under this Agreement. IMPLEADER. Contractor shall not implead or bring an action against Company or its customers or the employees of either based on any claim by any person for personal injury or death to an employee of Company or its customers occurring in the course or scope of employment and that arises out of material or services furnished under this Agreement.
IMPLEADER. Neither Party shall implead or bring an action against the other Party based on any claim by any person for personal injury or death to an employee of the other Party for which a Party has previously paid or is obligated to pay worker's compensation benefits to such employee or claimant and for which such employee or claimant could not otherwise bring legal action against the other Party.
IMPLEADER. Supplier shall not implead or bring an action against Lucent based on any claim by any person for personal injury or death to an employee of Lucent for which Lucent has previously paid or is obligated to pay worker's compensation benefits to such employee or claimant and for which such employee or claimant could not otherwise bring legal action against Lucent.
IMPLEADER. Yurie shall not implead or bring an action against AT&T or its customers or the employees of either based on any claim by any person for personal injury or death to an employee of AT&T or its customers occurring in the course or scope of employment and that arises out of material or services furnished under the purchase order.
IMPLEADER. VISUAL shall not implead or bring any action against AT&T or its customers or the employees of AT&T or its customers based on any claim by a person for personal injury or death to an employee of AT&T or its customers occurring in the course or scope of employment that arises out of Equipment, Software, Services or Materials furnished under this Agreement or an Order.
IMPLEADER. 25.1 Supplier will not implead or bring any action against Buyer or Ameritech Services, Inc. or their employees based on any claim by any person for personal injury or death that occurs in the course or scope of employment of such person by Supplier that arises out of Goods or Services provided under this Agreement.
IMPLEADER. The Administrator agrees that it will not implead or bring any action against the Company or its employees (acting in the course of their employment) based on any claim by any person for personal injury or death that occurs in the course or scope of employment of such person by the Administrator and that arises out of services furnished under this Agreement.
