Common use of Inapplicability of Tariff Liability Clause in Contracts

Inapplicability of Tariff Liability. GTE's general liability, as described in the GTE Retail Tariff, does not extend to DTI's customers or any other Third Party. Liability of GTE to DTI resulting from any and all causes arising out of services, facilities, network elements or any other items relating to this Agreement shall be governed by the liability provisions contained in this Agreement and no other liability whatsoever shall attach to GTE. GTE shall be liable for the individual services, facilities or elements that it separately provides to DTI and shall not be liable for the integration of components combined by DTI.
