Incomplete Submission. The Pharmaceutical Manufacturer shall have no obligation to pay State Supplemental Rebate amounts for claims that are not submitted as part of an invoice in accordance with Section 2.3 of this Agreement. The Pharmaceutical Manufacturer shall notify State or its designee of any incomplete submission within thirty-eight (38) days of the Pharmaceutical Manufacturer’s receipt of such submission pursuant to Section 2.3.
