State Supplemental Rebate Payment. The Pharmaceutical Manufacturer agrees to provide a State Supplemental Rebate for each of its Covered Products that is paid by the State and dispensed to Medicaid Members by Pharmacies for each calendar quarter that Covered Product(s) are included in the Preferred Drug List. The Pharmaceutical Manufacturer shall pay to State the State Supplemental Rebate amount in accordance with the formula set forth in Attachment B. Nothing in this Agreement shall be construed to relieve the Pharmaceutical Manufacturer from its obligation to pay Medicaid Drug Rebates for utilization by State Medicaid Members. State shall remit the appropriate share of the State Supplemental Rebate payments made under the Agreement to CMS as required under its approved state plan.

State Supplemental Rebate Payment. In addition to the CMS Basic Rebate and the CMS CPI Rebate, Manufacturer agrees to pay a Supplemental Rebate to DMAP for each of its Covered Product(s) dispensed to Medicaid Recipients by Pharmacies, or physicians (J- codes), for each calendar Quarter that Covered Product(s) are included in the PMPDP Plan Drug List based on the invoice submitted by DMAP or its contractor pursuant to paragraph 3.E. Manufacturer’s obligation to pay DMAP the Supplemental Rebate shall be as set forth in Attachment A. Nothing in this Agreement shall be construed to relieve Manufacturer from its obligation to pay CMS Medicaid Drug Rebates.
State Supplemental Rebate Payment. Manufacturer will provide the Department with the National Unit Rebate Amount for the Contracted Product(s) in accordance with Manufacturer’s National Drug Rebate Agreement. Manufacturer’s obligation to pay National Rebates will continue for the duration of the Manufacturer’s National Drug Rebate Agreement and shall not be impacted by State Supplemental Rebates hereunder. In addition to the National Rebate, Manufacturer agrees to provide a State Supplemental Rebate to DMMA for Medicaid Utilization of Contracted Products that are designated as Preferred Products on the PDL during the Quarter. Manufacturer shall pay the State Supplemental Rebate amount in accordance with the formula set forth in the Contracted Products Attachment. For the avoidance of doubt, as is the case with National Rebates, State Supplemental Rebates applicable to Participating Medicaid MCO utilization shall be payable to the DMMA, and shall not be paid directly to the Participating Medicaid MCOs, notwithstanding the Participating Medicaid MCO utilization will be invoiced separately from Fee-For-Service Medicaid Utilization. Nothing in this Agreement shall be construed to relieve Manufacturer from its obligation to pay National Rebates under contracts, if any, with CMS for utilization by Medicaid Recipients.
State Supplemental Rebate Payment. Each calendar quarter, manufacturer agrees to provide a State Supplemental Rebate for each of its Covered Products that is included in the Preferred Drug List and that is paid for by the State as a Covered Outpatient Drug in the calendar Quarter. Manufacturer shall pay to State the State Supplemental Rebate amount in accordance with the formula set forth in Attachment B. Nothing in this Agreement shall be construed to relieve Manufacturer from its obligation to make payments according to its CMS Agreement for utilization by State Medicaid Recipients and if applicable, those Medicaid Recipients enrolled in Participating Medicaid MCOs in accordance with Attachment C. State shall remit the appropriate share of the State Supplemental Rebate payments made under this Agreement to CMS as required under its approved state plan. While the State or its designee, may compute the total Supplemental Rebate anticipated, it shall remain the responsibility of the Manufacturer to correctly calculate the Supplemental Rebate amount owed to the State based on the applicable methodology set out in Attachment B. Manufacturer will also calculate and provide the State a CMS Rebate for the Supplemental Covered Product(s), which includes the CMS Basic Rebate and CMS Additional Rebate, as appropriate, in accordance with the terms of the CMS Agreement. Manufacturer’s obligation for CMS Rebates will continue for the duration of the Manufacturer’s CMS Agreement.
