Common use of Incremental Funding Clause in Contracts

Incremental Funding. ‌ If a prototype project agreement executed under this Agreement is incrementally funded, then the CM is not obligated to reimburse the Consortium Member for costs incurred in excess of the total amount allotted by the Government to the prototype project agreement, and the Consortium Member is not obligated to continue performance on the prototype project agreement (including actions under the Termination clause of this Agreement) or otherwise incur costs in excess of -- 1. The amount then allotted to the prototype project agreement by the Government, through the CM, or; 2. If the prototype project agreement involves cost-sharing, the amount then allotted by the Government to prototype project agreement plus the Consortium Member’s corresponding share, until the CM notifies the Consortium Member in writing that the amount allotted by the Government has been increased and specifies an increased amount, which shall then constitute the total amount allotted by the Government to the prototype project agreement.
