Common use of INDEPENDENT CONTRACTORS/THIRD PARTY BENEFICIARIES Clause in Contracts

INDEPENDENT CONTRACTORS/THIRD PARTY BENEFICIARIES. All work authorized under this Agreement that requires a contracting license pursuant to either Part I or Part II, Chapter 489, Florida Statutes, as amended, shall be performed by properly licensed contractors who shall obtain all necessary permits and inspections. The subcontracting of work by the Project Sponsor to properly licensed contractors shall not in any way affect the provisions of this Agreement. All contracts between the Project Sponsor and properly licensed contractors for work to be performed under this Agreement shall be in writing. This Agreement is for the benefit of the LCRA and the Project Sponsor. No third party is an intended beneficiary so as to entitle that person to sue for an alleged breach of this Agreement. The Project Sponsor acknowledges and agrees that it is acting as an independent contractor in performing its obligations hereunder and not as an agent, officer or employee of the LCRA.
