Independent Pricing. Partner will independently establish the price of the Bundled Solution for its Customers.
Independent Pricing. Nothing in this Agreement shall be ------------------- construed as restricting in any way LifeScan's discretion in setting the prices at which it resells Products and Services.
Independent Pricing. By submission of this bid, the bidder certifies, and in the case of a joint bid each party thereto certifies as to its own organization, that in connection with this procurement:
a. Unless otherwise required by law, the prices which have been quoted in this bid have not been knowingly disclosed by the bidder and will not knowingly be disclosed by the bidder prior to opening, directly or indirectly to any offeror or to any competitor; and
b. No attempt has been made or will be made by the bidder to induce any other person or firm to submit or not to submit a bid for the purpose of restricting competition.
Independent Pricing. THE OFFEROR CERTIFIES that:
A. The prices in this offer have been arrived at independently and without intent, for or the purpose to of restricting competition, and without any consultation, communication or agreement with any other bidder or competitor relating to these prices;
B. The prices in this offer have not been nor will be disclosed knowingly directly or indirectly to any other offeror or competitor before bid opening or Contract award unless otherwise required by law; and
C. No attempt has been made or will be made by the offeror to induce any other concern or individual to submit or not to submit an offer for the purpose of restricting competition.
Independent Pricing. By submission of this bid, the bidder certifies, and in the case of a joint bid each party thereto certifies as to its own organization, that in connection with this procurement: The prices in this bid have been arrived at independently, without consultation, communication, collusion, or Agreement(s) for the purpose of restricting competition, as to any matter relating to such prices with any other offeror or with any competitor.
a. Unless otherwise required by law, the prices which have been quoted in this bid have not been knowingly disclosed by the bidder and will not knowingly be disclosed by the bidder prior to opening, directly or indirectly to any offeror or to any competitor; and
b. No attempt has been made or will be made by the bidder to induce any other person or firm to submit or not to submit a bid for the purpose of restricting competition.
Independent Pricing. Notwithstanding any other provision of this Agreement, ********* shall have the right to determine the prices of ********* Products.
Independent Pricing. Participant shall set its own pricing for each Certified App offered through the Store in accordance with one or more of the pricing models described in the Guide. In a manner consistent with the Guide, Participant may modify its Store pricing for any Certified App at any time, with such modifications taking effect solely for new subscriptions or, upon reasonable notice to Customers, for renewals of new or existing subscriptions.
Independent Pricing. Pricing of any Licensed Intel Products marketed and distributed by Intel or SCM Products marketed and distributed by SCM will be at each party's sole discretion.
