Indexation of payments a. The parties acknowledge and agree that DCJ will develop an annual indexation mechanism during the first year of the Term which will apply to payments to be made to the Service Provider in the second and any subsequent years of the Term. The annual indexation mechanism will be determined by DCJ in its absolute discretion, but such mechanism may be consistent with:
i. an existing system of indexation utilised by DCJ; or
ii. any other system of indexation provided to DCJ by any other department or body of the NSW Government which is applied across all DCJ funding programs and may change from time to time.
Indexation of payments. 4.1 The County Council agrees that the sums payable to the Borough Council under paragraphs 1.1, 2.1, 3.1, 4.1, 4.2, 5.1, 6.1, 7.1, 8.1, 9.1, 10.5, and 11.2 of the Schedule hereto shall be increased in line with any increase in the Xxxxxx Index (or such other index of like effect as shall be agreed between the parties (such agreement not to be unreasonably withheld or delayed by either party) in the event that the Xxxxxx Index shall cease to be compiled) between the date of this Agreement and the date of payment in accordance with this Agreement
