Indiana Casino. Lakes recognizes that the Band intends to develop a casino in Indiana, and that the Band shall have no obligations to Lakes in that regard; except that the Band agrees that, if it decides to engage an outside manager to develop or operate an Indiana casino, it shall discuss contracting with Lakes for such development or operation for 45 days before soliciting proposals from third parties as to management or development of that casino. No obligation to enter into an agreement with Lakes shall be implied from this undertaking, and the Band shall retain full and absolute discretion in that regard.
