Common use of INDICTMENT - FORFEITURE Clause in Contracts

INDICTMENT - FORFEITURE. The indictment of, or institution of any legal process or proceeding against, the Borrower or any other Loan Party under any applicable Law where the relief, penalties, or remedies sought or available include the forfeiture of any property of Borrower and/or any other such Loan Party and/or the imposition of any stay or other order, the effect of which could be to restrain in any material way the conduct by the Borrower and/or any other such Loan Party of its business in the ordinary course.

The indictment of, or institution of any legal process or proceeding against, the Borrower or Borrower, any other Loan Party Party, and/or any Borrower Subsidiary under any applicable Law law where the relief, penalties, or remedies sought or available include the forfeiture of any property of Borrower and/or any other such Loan Party Person and/or the imposition of any stay or other order, the effect of which could be to restrain in any material way the conduct by the Borrower and/or any other such Loan Party Person of its business in the ordinary course.

The indictment of, or institution of any legal process or proceeding against, the Borrower any Credit Party, or any other Loan Party of its or their officers or directors, under any applicable Law law where the relief, penalties, or remedies sought or available are a felony or include the forfeiture of any more than $1,000,000 of property of Borrower and/or any other such Loan Credit Party and/or or the imposition of any stay or other order, the effect of which could be to restrain in any material way the conduct by the Borrower and/or any other such Loan Credit Party of its business in the ordinary course.

INDICTMENT - FORFEITURE. The indictment of, or institution of any legal process or proceeding against, the Borrower or Borrower, any other Loan Party (except for an Excepted Loan Party), and/or any Borrower Subsidiary under any applicable Law law where the relief, penalties, or remedies sought or available include the forfeiture of any property of Borrower and/or any other such Loan Party Person and/or the imposition of any stay or other order, the effect of which could reasonably be expected to restrain in any material way the conduct by the Borrower and/or any other such Loan Party of its business in the ordinary coursehave a Material Adverse Effect.

The indictment of, or institution of any legal process or proceeding against, the Borrower any Loan Party, or any other Loan Party of its or their officers or directors, under any applicable Law law where the relief, penalties, or remedies sought or available are a felony or include the forfeiture of any more than One Hundred Thousand and No/100 ($100,000) of property of Borrower and/or any other such Loan Party and/or or the imposition of any stay or other order, the effect of which could be to restrain in any material way the conduct by the Borrower and/or any other such Loan Party of its business in the ordinary course.

The indictment of, or institution of any legal process or proceeding against, the Borrower any Loan Party, or any other Loan Party of its or their officers or directors, under any applicable Law law where the relief, penalties, or remedies sought or available are a felony or include the forfeiture of any more than $250,000 of property of Borrower and/or any other such Loan Party and/or or the imposition of any stay or other order, the effect of which could be to restrain in any material way the conduct by the Borrower and/or any other such Loan Party of its business in the ordinary course.
