Information regarding Interconnection Facilities. 4.2.1 The SPD shall be required to obtain all information from the STU/ CTU/ concerned authority with regard to the Interconnection Facilities as is reasonably necessary to enable it to design, install and operate all interconnection plant and apparatus on the SPD’s side of the Delivery Point to enable delivery of electricity at the Delivery Point. All costs and charges including but not limited to the wheeling charges and losses up to and including at the Interconnection Point associated with this arrangement will also be borne by the SPD. 4.2.4 In case of Pooling substation, losses in the transmission line shall be apportioned among the SPDs who share such a Pooling arrangement, based on their monthly generation. 4.2.5 The arrangement of connectivity shall be made by the SPD through a dedicated transmission line. The entire cost of transmission including cost of construction of line, any other charges, losses etc. from the Project up to the Interconnection Point will be borne by the SPD. In case of any delay in connectivity to the Project and non- availability of Grid and Transmission System during Term of this Agreement, for reasons not attributable to the SPD, provisions of Article 4.9 shall be applicable.

In case the commissioning of the Project gets delayed beyond the applicable date of ISTS waiver, arising out of any reasons whatsoever, SECI shall bear no liability with respect to transmission charges and losses levied, if any.

The transmission of power up to the point of interconnection where the metering is done for energy accounting shall also be the responsibility of the SPD at his own cost. The maintenance of Transmission system up to the interconnection /Metering/Delivery point shall also be the responsibility of the SPD. 4.2.2 4.2.3 The entire cost of transmission including cost of construction of line, any other charges, losses etc. from the Project up to the interconnection /Metering/Delivery Point shall be borne by the SPD and the same will not be reimbursed by NTPC or met by any other entity to whom this solar power is sold by NTPC. Copy of Long Term Access (LTA) agreement shall also be made submitted by the SPD through a dedicated transmission line. The entire cost one month prior to commissioning of transmission including cost of construction of line, any other charges, losses etc. from the Project up to the Interconnection Point will be borne by the SPDProject. In case of any delay in the project developer is unable to obtain connectivity to and/or LTA at least one month before proposed commissioning date for the Project and non- availability of Grid and Transmission System during Term of this Agreement, for reasons not attributable to the SPD, provisions of Article 4.9 shall be applicable.and it is established that the SPD has complied with the complete application formalities as per Clause

Information regarding Interconnection Facilities. 4.2.1 The SPD shall be required to obtain all necessary information from the STU/ CTU/ NTPC/CTU / concerned authority with regard to the Interconnection Facilities as is reasonably necessary interconnection at existing NTPC switchyard in Western Region to enable it to design, install and operate Plant and all interconnection plant and apparatus interconnecting apparatus/ equipment on the SPD’s side of the Delivery Point to enable delivery of electricity at the interconnection /Metering/Delivery Point. 4.2.2 The responsibility of getting connectivity with the transmission system up to interconnection /Metering/Delivery point, will entirely be of the SPD, at its cost and responsibility. The transmission of power up to the point of interconnection where the metering is done for energy accounting shall also be the responsibility of the SPD at his own cost. The maintenance of Transmission system upto the interconnection /Metering/Delivery point shall be the responsibility of the SPD. 4.2.2 4.2.3 The entire cost of transmission including cost of construction of line, any other charges, losses etc. from the Project up to the interconnection /Metering/Delivery Point shall be borne by the SPD and the same will not be reimbursed by NTPC or met by the Discom(s). The entire cost project developer one month prior to commissioning of transmission including cost of construction of line, any other charges, losses etc. from the Project up to the Interconnection Point will be borne by the SPDProject. In case of any delay in the project developer is unable to obtain connectivity to and/or LTA at least one month before proposed commissioning date or Scheduled Commissioning Date as the Project and non- availability of Grid and Transmission System during Term of this Agreement, case may be for the reasons not attributable to the SPD, provisions of Article 4.9 shall and it is established that the project developer has complied with the complete application formalities as per Clause 3.1 h), and has adhered to the applicable Procedure in this regard as notified by the CERC/CTU, the Scheduled Commissioning Date for the Project may be applicable.extended for a period upto Twelve

The transmission of power up to the point of interconnection where the metering is done for energy accounting shall be the responsibility of the SPD at his own cost. 4.2.2 Penalties, fines and charges imposed by the CTU/ STU under any statute or regulation in relation to delay in commissioning of Project shall be payable by the SPD to the extent the delay is attributable to the SPD. 4.2.3 The responsibility of getting connectivity with the transmission system up to the Interconnection PointPoint as per the SPIA terms and conditions, will lie with the SPD. The entire cost of transmission including cost of construction of line, any other charges, losses etc. from the Project up to the Interconnection Point will be borne by the SPD. In case of any delay in connectivity to the Project and non- non-availability of Grid and Transmission System during Term of this Agreement, for reasons not attributable to the SPD, provisions of Article 4.9 14 shall be applicable. 4.2.6 Interconnection Delivery point will be at the Grid substation and therefore from Generators substation/switchyard transmission line will be in scope of SPIA. The maintenance of Transmission system up to the Inter-connection Point shall be adhered to as per the Terms and Conditions of SPIA.

However, in case the commissioning of the Project gets delayed beyond the applicable date of ISTS waiver/extended SCD as above, due to reasons attributable to the SPD, the liability of transmission charges and losses would be to the account of the SPD. Delay in Project commissioning beyond the deadline as stipulated by the Government of India, and treatment of ISTS charges and losses thereof, shall be dealt in line with the Central Electricity Regulatory Commission (Sharing of Inter- State Transmission Charges and Losses) (First Amendment) Regulations, 2023 dated 07.02.2023, and subsequent amendments and clarifications thereto, as applicable.

The transmission of power up to the point of interconnection where the metering is done for energy accounting shall be the responsibility of the SPD at his own cost. 4.2.2 Penalties, fines and charges imposed by the CTU/ STU under any statute or regulation in relation to delay in commissioning of Project shall be payable by the SPD to the extent the delay is attributable to the SPD. 4.2.3 The responsibility of getting connectivity with the transmission system up to the Interconnection Point, will lie with the SPD. The transmission of power up to the point of interconnection where the metering is done for energy accounting shall be the responsibility of the SPD at his own cost. The maintenance of Transmission system up to the designated point as per the terms and conditions of CTU/ STU SPIA shall be the responsibility of the SPD. All costs and charges including but not limited to the wheeling charges and losses up to and including at the Interconnection Point associated with this arrangement will also be borne by the SPD. 4.2.4 In case of Pooling substation, losses in the transmission line shall be apportioned among the SPDs who share such a Pooling arrangement, based on their monthly generation. 4.2.5 The arrangement of connectivity shall be made by the SPD through a dedicated transmission line. The entire cost of transmission including cost of construction of line, any other charges, losses etc. from the Project up to the Interconnection Point will be borne by the SPD. In case of any delay in connectivity to the Project and non- availability of Grid and Transmission System during Term of this Agreement, for reasons not attributable to the SPD, provisions of Article 4.9 4.10 shall be applicable.

In case the commissioning of the Project gets delayed beyond the applicable date of ISTS waiver, arising out of any reasons whatsoever, SECI shall bear no liability with respect to transmission charges and losses levied, if any. In case the SCD of the Project is before the date till above ISTS waiver is applicable, and if the Project is granted extension in the SCD on account of Force Majeure, or for delay on the part of the transmission provider in providing the transmission even after having taken the requisite steps in time; or on account of delays on the part of any Government Agency, and the Project is commissioned before the extended SCD; it will get benefit of waiver of inter-state transmission charges. However, in case the commissioning of the Project gets delayed beyond the applicable date of ISTS waiver/extended SCD as above, due to reasons attributable to the SPD, the liability of transmission charges and losses would be to the account of the SPD.
