Common use of Information Safeguards Clause in Contracts

Information Safeguards. Business Associate shall develop, implement, maintain, and use appropriate administrative, technical, and physical safeguards, in compliance with HIPAA, HITECH, and any other implementing regulations issued by the United States Department of Health and Human Services. The safeguards shall be designed to preserve the integrity and confidentiality of, and to prevent any nonpermitted or violating use or disclosure of, Protected Health Information. Business Associate shall keep the safeguards current.

Information Safeguards. Business Associate shall will develop, implement, maintain, maintain and use appropriate administrative, technical, technical and physical safeguards, in compliance with HIPAASocial Security Act §1173(d) (42 U.S.C. §1320d-2(d)), HITECH45 CFR §164.530(c), and any other implementing regulations issued by in support of the United States Department of Health and Human Services. The safeguards shall be designed HIPAA Rules and, as well, the GLBA Rules, to preserve the security, integrity and confidentiality of, privacy of and to prevent any nonpermitted non-permitted or violating use Use or disclosure of, Protected Health Disclosure of Private Information. Business Associate shall will document and keep the these safeguards current.

The safeguards 164.312 which shall be designed apply to preserve the integrity and confidentiality of, and to prevent any nonpermitted or violating use or disclosure of, Protected Health Information. Business Associate shall keep in the safeguards current.same manner that such sections apply to

The safeguards shall be designed to preserve the integrity and confidentiality of, of and to prevent any nonpermitted non-permitted or violating use or disclosure of, Protected Health Information. Business Associate shall keep the safeguards currentof PHI which is transmitted electronically.

The safeguards shall be designed to preserve the integrity integrity, confidentiality, and confidentiality of, availability of and to prevent any nonpermitted unauthorized disclosures of Personal and Health Information created or violating use received for or disclosure of, Protected Health Informationfrom Covered Entity. Business Associate shall document and keep the such safeguards currentcurrent and, upon Covered Entity’s reasonable request, shall provide Covered Entity with a copy of policies and procedures related to such safeguards.
