Information Supplied by the Initial Purchasers. The statements set forth in the second paragraph of the “Plan of Distribution—New Issue of Notes; No Registration” section, the fourth and fifth sentences of the third paragraph of the “Plan of Distribution—New Issue of Notes; No Registration” section and the first and second paragraphs of the “Plan of Distribution—Price Stabilization and Short Positions” section in the Preliminary Memorandum and the Final Memorandum (to the extent such statements relate to the Initial Purchasers) constitute the only information furnished by the Initial Purchasers to the Company for the purposes of Sections 2(a) and 9 hereof.
