Common use of Information Supplied by the Initial Purchasers Clause in Contracts

Information Supplied by the Initial Purchasers. The name of the Initial Purchasers set forth on the front cover, back cover and under the heading “Plan of Distribution” of the Offering Memorandum, the statements set forth on the cover page with respect to price and the statements set forth in (a) the first sentence of the third paragraph and (b) the fourth paragraph and (c) the first, second, third and fourth sentences of the seventh paragraph under the heading “Plan of Distribution” in the Pricing Disclosure Package and the Final Offering Memorandum (to the extent such statements relate to the Initial Purchasers) (the “Initial Purchaser Information) constitute the only information furnished by the Initial Purchasers to the Company or the Guarantors for the purposes of Sections 4(a) and 8 hereof.

The name names of the Initial Purchasers set forth on the front cover, and back cover and under the heading “"Plan of Distribution” " of the Offering Memorandum, the statements set forth on the cover page with respect to price Circular and the statements set forth in in: (ai) the fourth full paragraph on page ii regarding stabilization by the Initial Purchasers, (ii) the first sentence of the third paragraph, the second and third sentence of the tenth paragraph and (b) the fourth paragraph and (c) the first, second, third and fourth sentences of the seventh eleventh paragraph under the heading “"Plan of Distribution” " in the Pricing Disclosure Package and the Final Offering Memorandum Circular (to the extent such statements relate to the Initial Purchasers) (the “"Initial Purchaser Purchasers Information") constitute the only information furnished by the such Initial Purchasers as to itself to the Company or the Guarantors its Subsidiaries for the purposes of Sections 4(a) and 8 hereof.
