Common use of Initial Occupancy Clause in Contracts

Initial Occupancy. (A) Sublessee represents that it has inspected the demised premises and agrees to take the same in its present "As Is" condition, and Sublessee acknowledges that no representations with respect to the condition thereof or otherwise, of any kind or nature, have been made. Any work required by Sublessee to prepare the demised premises for its occupancy shall be paid for by Sublessee and shall be subject to all of the terms, covenants, conditions, provisions and agreements set forth in the Underlying Lease.
