Installation and Maintenance. Except for the bi‐directional and production metering equipment owned by the City, all equipment on Customer’s side of the delivery point, including the required disconnect device, shall be provided and maintained in satisfactory operating condition by Customer and shall remain the property and responsibility of the Customer. The City will bear no responsibility for the installation or maintenance of Customer’s equipment or for any damage to property as a result of any failure or malfunction thereof. The City shall not be liable, directly or indirectly for permitting or continuing to allow the interconnection of the Facility or for the acts or omissions of Customer or the failure or malfunction of any equipment of Customer that causes loss or injury, including death, to any party.

Installation and Maintenance. You agree to indemnify and hold Alpine and its employees and agents harmless from all claims, demands and causes of action of every nature or kind, caused by, arising from or developing out of or as a result of any act or failure to act by Alpine in connection with the installation, connection, maintenance, operation, failure and removal of any leased equipment or any CPE, except as caused solely by the gross negligence or willful misconduct of Alpine. You expressly assume all risks associated with installation, connection, maintenance, operation, failure and removal of leased equipment and CPE.

HWE shall bear no liability for Member/Owner's equipment or for consequences of its operation or miss-operation. For purposes of gathering research data, HWE may at its expense install and operate additional metering and data gathering devices.

Installation and Maintenance. The IMC shall agree upon the specifications for Intertie-related metering equipment before its installation. Each Participant hereby grants to all other Participants the right to install and maintain at the installing Participants’ cost, Intertie-related equipment in other Participants’ substations. Each Participant has the right to install and maintain, at its cost, equipment in another Participant’s substation only if the equipment is necessary to perform Intertie functions under this Agreement. The installation and maintenance shall be coordinated with staff of the Participant owning and operating the facilities on which the meters are to be installed. Ingress and egress shall be granted to the other Participants to install, remove, or maintain such equipment. Participants shall coordinate such activities.
Installation and Maintenance. WIN shall not be liable for any damages occurring as a result of installation and/or maintenance except for damage caused by the gross negligence or willful misconduct on the part of WIN or its agents. Installation and Maintenance. Customer is responsible for locating and marking all facilities (irrigation, water, sewer, drainage, etc.) in areas where digging will take place if not part of the Palmetto Utility Protection Service (PUPS). Company is not responsible for any damage to Customer owned utilities such as irrigation, sewer, cable, water taps, etc. that have not been located or have been mis-located. Customer is responsible for obtaining all applicable authorizations and permissions from any governmental entities related to luminaires, poles, and/or related equipment.
