Common use of Instruments in Writing Clause in Contracts

Instruments in Writing. All actions which may be taken and all powers that may be exercised by the Receiptholders at a meeting held as provided in this Article 7 may also be taken and exercised by an instrument in writing signed in one or more counterparts by such Receiptholders in person or by attorney duly appointed in writing, by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receipts with respect to an Extraordinary Resolution, and the expression “Extraordinary Resolution” when used in this Agreement shall include an instrument so signed by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receipts.

Instruments in Writing. All actions which may be taken and all powers that may be exercised by the Receiptholders at a meeting held as provided in this Article 7 may also be taken and exercised by an instrument in writing signed in one or more counterparts by such Receiptholders in person or by attorney duly appointed in writing, by Receiptholders holding at least 66⅔% 66 2/3% of the then outstanding Subscription Receipts with respect to an Extraordinary Resolutionextraordinary resolution, and the expression “Extraordinary Resolution” "extraordinary resolution" when used in this Agreement shall include an instrument so signed by Receiptholders holding at least 66⅔% 66 2/3% of the then outstanding Subscription Receipts.

All actions which may be taken and all powers that may be exercised by the Subscription Receiptholders at a meeting held as provided in this Article 7 VIII may also be taken and exercised by Subscription Receiptholders holding at least two-thirds of the aggregate number of the then outstanding Subscription Receipts by an instrument in writing signed in one or more counterparts by such Subscription Receiptholders in person or by attorney duly appointed in writing, by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receipts with respect to an Extraordinary Resolution, and the expression “Extraordinary Resolutionextraordinary resolution” when used in this Agreement shall include an instrument so signed by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receiptssigned.

Instruments in Writing. All actions which that may be taken and all powers that may be exercised by the Subscription Receiptholders at a meeting held as provided hereinbefore in this Article 7 9 provided may also be taken and exercised by Subscription Receiptholders representing in the case of such actions and powers not requiring an extraordinary resolution, at least 51% and, in the case of such actions and powers requiring an extraordinary resolution, at least 66 ⅔% of the aggregate number of then outstanding Subscription Receipts by an instrument in writing signed in one or more counterparts by such Subscription Receiptholders in person or by attorney duly appointed in writing, by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receipts with respect to an Extraordinary Resolution, writing and the expression “Extraordinary Resolutionextraordinary resolution” when used in this Agreement shall include an instrument so signed by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receiptssigned.

Instruments in Writing. All actions which that may be taken and all powers that may be exercised by the Subscription Receiptholders at a meeting held as provided hereinbefore in this Article 7 9 provided may also be taken and exercised by Subscription Receiptholders holding two-thirds of the aggregate number of Subscription Receipts then outstanding by an instrument in writing signed in one or more counterparts by such Subscription Receiptholders in person or by attorney duly appointed in writing, by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receipts with respect to an Extraordinary Resolution, writing and the expression “Extraordinary Resolutionextraordinary resolution” when used in this Agreement shall include an instrument so signed by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receiptssigned.

All actions which that may be taken and all powers that may be exercised by the Subscription Receiptholders at a meeting held as provided hereinbefore in this Article 7 9 provided may also be taken and exercised by Subscription Receiptholders representing in the case of such actions and powers not requiring an extraordinary resolution, at least 51% and, in the case of such actions and powers requiring an extraordinary resolution, at least 66 ⅔% of the aggregate number of then outstanding Subscription Receipts by an instrument in writing signed in one or more counterparts by such Subscription Receiptholders in person or by attorney duly appointed in writing, by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receipts with respect to an Extraordinary Resolution, writing and the expression “Extraordinary Resolutionextraordinary resolution” when used in this Agreement shall include an instrument so signed by Receiptholders holding at least 66⅔% of the then outstanding Subscription Receipts.signed. 50793135.4
