Common use of Insurance Cover Clause in Contracts

Insurance Cover. Without prejudice to the provisions contained in Clause 26.1, the Concessionaire shall, during the Operation Period, procure and maintain Insurance Cover including but not limited to the following: (a) Loss, damage or destruction of the Project Assets, including assets handed over by the Authority to the Concessionaire, at replacement value; (b) Comprehensive third party liability insurance including injury to or death of personnel of the Authority or others caused by the Project; (c) The Concessionaire’s general liability arising out of the Concession; (d) Liability to third parties for goods or property damage; (e) Workmen’s compensation insurance; and (f) any other insurance that may be necessary to protect the Concessionaire and its employees, including all Force Majeure Events that are insurable at commercially reasonable premiums and not otherwise covered in items(a) to (e) above.

Insurance Cover. 27.2.1 Without prejudice to the provisions contained in Clause 26.1Article 27.1, the Concessionaire shall, during the Operation Period, procure and maintain Insurance Cover including but not limited to the following: (a) Loss, damage or destruction of the Project Assets, including assets handed over by the Authority to the Concessionaire, at replacement value; (b) Comprehensive comprehensive third party liability insurance including injury to or death of personnel of the Authority or others caused by who may enter the ProjectResort and Project Infrastructure; (c) The the Concessionaire’s 's general liability arising out of the Concession; (d) Liability liability to third parties for goods or property damage; (e) Workmen’s workmen's compensation insurance; and (f) any other insurance that may be necessary to protect the Concessionaire and its employees, including all Force Majeure Events that are insurable at commercially reasonable premiums and not otherwise covered in items(aitems (a) to (ed) above.

Without prejudice to the provisions contained in Clause 26.115.1, the Concessionaire Supplier shall, during the Operation Operations Period, procure and maintain [and cause the Developer to procure and maintain, as the case may be, if Supplier is a Trading Licensee] Insurance Cover including but not limited to the following: (a) Loss, damage or destruction of the Project Assets, including assets handed over by the Authority to the Concessionaire, Assets at replacement value; (b) Comprehensive comprehensive third party liability insurance including injury to or death of personnel of the Authority Utility or others caused by the Project; (c) The Concessionairethe Supplier’s general liability arising out of the ConcessionProcurement Contract; (d) Liability liability to third parties for goods or property damage; (e) Workmenworkmen’s compensation insurance; and (f) any other insurance that may be necessary to protect the Concessionaire Supplier and its employees, including all Force Majeure Events that are insurable at commercially reasonable premiums and not otherwise covered in items(aitems (a) to (e) above.

Without prejudice to the provisions contained in Clause 26.115.1, the Concessionaire Supplier shall, during the Operation Operations Period, procure and maintain [and cause the Developer to procure and maintain, as the case may be, if Supplier is a Trading Licensee] Insurance Cover including but not limited to the following: (a) Loss, damage or destruction of the Project Assets, including assets handed over by the Authority to the Concessionaire, Assets at replacement value; (b) Comprehensive comprehensive third party liability insurance including injury to or death of personnel of the Authority Utility or others caused by the Project; (c) The Concessionaire’s the Supplier‟s general liability arising out of the ConcessionProcurement Contract; (d) Liability liability to third parties for goods or property damage; (e) Workmen’s workmen‟s compensation insurance; and (f) any other insurance that may be necessary to protect the Concessionaire Supplier and its employees, including all Force Majeure Events that are insurable at commercially reasonable premiums and not otherwise covered in items(aitems (a) to (e) above.

Insurance Cover. 27.2.1 Without prejudice to the provisions contained in Clause 26.127.1, the Concessionaire shall, during the Operation Operations Period, procure and maintain Insurance Cover including but not limited to the following: (a) Loss, damage or destruction of the Project Assets, including assets handed over by the Authority to the Concessionaire, at replacement value; (b) Comprehensive third comprehensive third-party liability insurance including injury to or death of personnel of the Authority or others caused by who may enter the ProjectHotel and the Project Infrastructure; (c) The the Concessionaire’s general liability arising out of the Concession; (d) Liability liability to third parties for goods or property damage; (e) Workmenworkmen’s compensation insurance; and (f) any other insurance that may be necessary to protect the Concessionaire and its employees, including all Force Majeure Events that are insurable at commercially reasonable premiums and not otherwise covered in items(aitems (a) to (ef) above.

Without prejudice to the provisions contained in Clause 26.1Article 14.1, the Concessionaire shall, during the Operation Contract Period, procure and maintain Insurance Cover including but not limited to the following: (a) Lossloss, damage or destruction of the Project Assets, including assets handed over by the Authority to the Concessionaire, Assets at replacement value; (b) Comprehensive comprehensive third party liability insurance including injury to or death of personnel of the Authority NMMC or others caused by the Project; (c) The the Concessionaire’s general liability arising out of the Concessionthis Agreement; (d) Liability liability to third parties for goods or property damage; (e) Workmenworkmen’s compensation insurance; and (f) any other insurance that may be necessary to protect the Concessionaire and its employees, including all Force Majeure Events that are insurable at commercially reasonable premiums and not otherwise covered in items(aitems (a) to (e) above.

Without prejudice to the provisions contained in Clause 26.1, the Concessionaire shall, during the Operation Period, procure and maintain Insurance Cover including but not limited to the following: (a) Loss, damage or destruction of the Project Assets (including Existing Assets, including assets handed over by the Authority to the Concessionaire), at replacement value; (b) Comprehensive third party liability insurance including injury to or death of personnel of the Authority or others caused by the Project; (c) The Concessionaire’s Concessionaire‟s general liability arising out of the Concession; (d) Liability to third parties for goods or property damage; (e) Workmen’s Workmen‟s compensation insurance; and (f) any other insurance that may be necessary to protect the Concessionaire and its employees, including all Force Majeure Events that are insurable at commercially reasonable premiums and not otherwise covered in items(aitems(i) to (ev) above.
