INTEGRATED HEALTH DISABILITY INCOME INSURANCE PLAN. 15.01 Effective upon ratification of this collective agreement by the principals, or no later than December 31, 1997, any and all prior articles or by-laws pertaining to an accumulative sick leave credit plan and lump sum payment or gratuity, are null and void, it being understood that the short term/long term disability income insurance plan and outstanding lump sum gratuity credit shall be administered as noted in this article. 15.02 The Employer will provide an integrated health disability income insurance plan for full- time employees upon successful completion of his probationary period as follows and as detailed in the attached Schedule A: 15.03 The number of days or part days for which an employee receives sick pay shall be charged in accordance with Schedule A and deducted from his accumulated frozen sick leave credit plan, where not otherwise covered under Schedule A. Deductions shall be made from accumulated sick leave of all working days absent on sick leave (exclusive of holidays) as defined in this Article. All absences due to sickness shall be deducted on a straight time basis and charged to the nearest one-quarter (l/4) hour. Sick leave pay will be at the employee’s basic wage rate excluding shift, overtime or other premiums. 15.04 It is agreed that either Management or the Union may request the Home physician to visit employees where there is some doubt as to the seriousness of the illness and whether it requires absence from work. 15.05 A record of all unused sick leave will be kept by the Corporation; and the Corporation shall advise each employee with a written statement of his accumulated sick leave credit on an annual basis. 15.06 A full-time employee who has successfully completed his probationary period may utilize sick leave allowance for absence from employment: (i) caused by personal illness or physical incapacity caused by factors over which the employee has no reasonable or immediate control, provided that when an employee is in receipt of an award under the Workers' Compensation Act he or she shall be excluded from utilizing sick leave allowance except to the extent provided in Article 17.03; (ii) caused by exposure to contagious disease that in the opinion of the Medical Officer of Health or Home physician might endanger the health of other employees or residents by his attendance on duty; (iii) caused by any medical or dental appointment exceeding two (2) hours of absence. Three medical/dental appointments within the calendar year not exceeding two (2) hours per occurrence are permissible. The fourth and subsequent occurrences in the calendar year will be charged to the employee’s lieu time or vacation record unless otherwise agreed with the manager through a temporary flex time arrangement. 15.07 Payment under the Integrated Health Disability Income Insurance Plan shall be subject to the following conditions: (i) an employee shall on the first day of illness report such illness to the Manager of Building Services (Chief Engineer). The employee shall cause notice to his immediate manager at least one (1) hour before the start of the shift; (ii) the Employer may require an employee to produce a Treatment Memorandum Form from a qualified health care provider for any illness, certifying that such employee is unable to carry out his duties due to illness or injury; (iii) in the event an employee fails to report on the first day or fails to file a doctor's certificate as outlined above, he or she shall not be entitled to any sick leave benefits as provided herein unless in the opinion of the Manager of Building Services (Chief Engineer) there was reasonable justification for the employee's failure to file the said certificate. 15.08 The accumulated sick leave credit plan shall be capped effective December 31, 1997 and frozen at the wage rate received by such employee on August 1, 1991, it being understood that each eligible employee shall receive a statement from the Corporation advising of the number and value of the frozen credits. On an annual basis, the Corporation will recalculate and adjust the number of sick leave credits (days/hours) resulting from any change in rates of pay. The employee shall be provided the following options: a) Sick Leave Utilization – Frozen sick leave credits may be used by the employee to replace or supplement income during illness on the basis that one (1) hour will be charged to the sick leave bank for every hour used by the employee, to the nearest quarter hour. b) Gratuity Payout – Employees may elect to receive payment in the form of money or to replace with other mutually-agreed mechanism (e.g. health spending accounts) for all or a portion of any sick leave credits at the frozen value on the following basis: For employees with vested sick leave credits, the Corporation will pay out on a schedule of annual instalments subject to the availability of sick leave reserve funds the first 260 days of vested sick leave credits to a maximum of six (6) months earning on the basis of one (1) day’s pay for two (2) days’ credit, at the wage rate received by the employee on August 1, 1991. The annual installment shall be at least 15% of the employee’s eligible payout as described above, it being understood that this percentage may be increased by the Director of Corporate Services depending upon reserve fund availability.

ii) For employees with sick leave credits remaining after utilization as outlined in a) above or payout in b) i) above, the Corporation shall pay out any remaining sick leave credits upon death, termination or retirement on the following basis: · For credits up to 260 days, 1 day's base wage for 2 days' credit; · For credits exceeding 260 days, 1 day's base wage for 3 days' credit.
26.05 After three (3) consecutive days of illness, the Corporation may require an employee to produce a treatment memorandum from a qualified health care provider for any illness certifying that such employee is unable to carry out his duties due to illness or injury. Also, to the best of the physicians ability at the wage rate received by time, an estimate of the duration of absence must be given. The exemption from requiring the certificate for three (3) consecutive days of illness shall be applicable only once in the calendar year.
26.06 If an employee suffers a compensable injury while on the job:
(a) the Corporation will pay him for the balance of his shift;
(b) following the day of injury, if and while the employee is eligible for full Workplace Safety and Insurance Board payments, the Corporation shall pay to such employee after deducting welfare plan premiums and pension plan contributions payable by such employee, and during and limited to the period for which sick leave credits are available, net sick leave pay, the total of which would represent one- quarter day's pay per normal working day, charging one-quarter day against such employee's sick leave credits.
26.07 Employees having ten (10) or more years of continuous service with the Corporation on August 1December 31, 1991. The annual installment shall be at least 15% 1968 and who had established sick leave credits under the personnel policies of the employee’s eligible payout as described aboveformer St. Catharines-Lincoln Health Unit (Section 12 (1) to (4) shall, it being understood that this percentage may be increased by on termination of employment receive a sick leave gratuity amounting to one-half (1/2) of the Director sick leave standing to his credit at December 31, 1968 subject to a maximum of Corporate Services depending upon reserve fund availability.six

Travel time may be included in this paid leave. Nurses may request to use unpaid leave of absence, or paid time from other banks, for appointments in addition to the paid leave and such requests shall not be unreasonably denied. It is understood that for newly hired nurses or for nurses who transfer to a full-time position, medical appointment time will be pro-rated for the remaining duration of the shift;twelve (12) month period. There shall be no carryover of unused medical/health related time and medical/health related time shall be reset at the expiry of each twelve (12) month period.

15.05 If a nurse suffers a compensable injury while on duty:
(a) (s)he shall report same to the basis Program Manager's office as soon as possible;
(b) the Employer will pay her/his for the balance of one the work day;
(1c) day’s pay It is agreed that a nurse who is absent from work as a result of an illness or injury sustained at work, and who is waiting for two (2) days’ creditapproval from the WSIB for his/her current absence, at will be advanced a base wage continuance in amount equivalent to that paid under an approved WSIB benefit, until the wage rate received time of approval or denial by the employee on August 1, 1991. There shall be no carryover of unused medical/health related time and medical/health related time shall be reset at the expiry of each twelve (12) month period.
(ii) the 15.04 The Employer may require an employee a nurse to produce a Treatment Memorandum Form from completed by a qualified health care provider medical practitioner for any illness, certifying that such employee nurse is unable to carry out her/his duties due to illness or injury;
(iii) in . Should there be a cost to the event an employee fails to report on nurse for the first day or fails to file a doctor's certificate as outlined above, he or she shall not be entitled to any sick leave benefits as provided herein unless in the opinion completion of the Manager of Building Services (Chief Engineer) there was reasonable justification for the employee's failure to file the said certificate.
15.08 The accumulated sick leave credit plan Treatment Memorandum Form such cost shall be capped effective December 31, 1997 and frozen at the wage rate received by such employee on August 1, 1991, it being understood that each eligible employee shall receive a statement from the Corporation advising of the number and value of the frozen credits. On an annual basis, the Corporation will recalculate and adjust the number of sick leave credits (days/hours) resulting from any change in rates of pay. The employee shall be provided the following options:
a) Sick Leave Utilization – Frozen sick leave credits may be used reimbursed by the employee to replace or supplement income during illness on the basis that one (1) hour will be charged to the sick leave bank for every hour used by the employee, to the nearest quarter hour.
b) Gratuity Payout – Employees may elect to receive payment in the form of money or to replace with other mutually-agreed mechanism (e.g. health spending accounts) for all or a portion of any sick leave credits at the frozen value on the following basis: For employees with vested sick leave credits, the Corporation will pay out on a schedule of annual instalments subject to the availability of sick leave reserve funds the first 260 days of vested sick leave credits Employer to a maximum of six $75.00 dollars should the receipt be provided within ten (610) months earning working days of the employer receiving the Treatment Memorandum Form.
15.05 If a nurse suffers a compensable injury while on duty:
(a) (s)he shall report same to the basis Program Manager's office as soon as possible;
(b) the Employer will pay her/his for the balance of one the work day;
(1c) day’s pay It is agreed that a nurse who is absent from work as a result of an illness or injury sustained at work, and who is waiting for two (2) days’ creditapproval from the WSIB for his/her current absence, at will be advanced a base wage continuance in amount equivalent to that paid under an approved WSIB benefit, until the wage rate received time of approval or denial by the employee on August 1, 1991. The annual installment shall be at least 15% of the employee’s eligible payout as described above, it being understood that this percentage may be increased by the Director of Corporate Services depending upon reserve fund availabilityWSIB.

INTEGRATED HEALTH DISABILITY INCOME INSURANCE PLAN. 15.01 Effective upon ratification of this collective agreement by the principals, or no later than December 31, 1997, any and all prior articles or by-laws pertaining to an accumulative sick leave credit plan and lump sum payment or gratuity, are null and void, it being understood that the short term/long term disability income insurance plan and outstanding lump sum gratuity credit shall be administered as noted in this article.
15.02 The Employer will provide an integrated health "Integrated Health Disability Income Insurance Plan" for full-time nurses with three (3) months' service or more and absent from the workplace due to disability income insurance plan for full- time employees upon successful completion of his probationary period as follows and as detailed in the attached Schedule A:
15.03 The number of days or part days for which an employee receives sick pay shall be charged in accordance with Schedule A and deducted from his accumulated frozen sick leave credit plan"B". In any event, where not otherwise covered under Schedule A. Deductions shall be made from accumulated sick leave of all working days absent on sick leave (exclusive of holidays) as defined in this Article. All absences due a nurse’s eligibility to sickness shall be deducted on a straight time basis and charged to the nearest one-quarter (l/4) hour. Sick leave pay will be at the employee’s basic wage rate excluding shift, overtime or other premiums.
15.04 It is agreed that either Management or the Union may request the Home physician to visit employees where there is some doubt as to the seriousness of the illness and whether it requires absence from work.
15.05 A record of all unused sick leave will be kept by the Corporation; and the Corporation shall advise each employee with a written statement of his accumulated sick leave credit on an annual basis.
15.06 A full-time employee who has successfully completed his probationary period may utilize sick leave allowance for absence from employment:
(i) caused by personal illness or physical incapacity caused by factors over which the employee has no reasonable or immediate control, provided that when an employee is in receipt of an award under the Workers' Compensation Act he or she shall be excluded from utilizing sick leave allowance except to the extent provided in Article 17.03;
(ii) caused by exposure to contagious disease that in the opinion of the Medical Officer of Health or Home physician might endanger the health of other employees or residents by his attendance on duty;
(iii) caused by any medical or dental appointment exceeding two (2) hours of absence. Three medical/dental appointments within the calendar year not exceeding two (2) hours per occurrence are permissible. The fourth and subsequent occurrences in the calendar year will be charged to the employee’s lieu time or vacation record unless otherwise agreed with the manager through a temporary flex time arrangement.
15.07 Payment receive benefits under the Integrated Health Disability Income Insurance Plan agreed to in this Agreement shall receive an amount which shall not be subject less than the amount required to meet the following conditions:employment Insurance Premium Reduction Criteria.

Travel time may be included in this paid leave. It is understood that for newly hired nurses or for nurses who transfer to a full-time position, medical appointment time will be pro-rated for the remaining duration of the shift;twelve (12) month period.
