This article applies to international submarine cable systems where, under national law and regulation, a Party has authorised a supplier of public telecommunications services in its territory to operate a submarine cable system as a public telecommunications service.

International Submarine Cable Systems. Where a Party has authorised a supplier of public telecommunications networks or services in its territory to operate an international submarine cable system as a public telecommunications network or service, that Party shall ensure that such supplier accords the suppliers of public telecommunications networks or services of another Party reasonable and non-discriminatory treatment for access to the international submarine cable system.8, 9, 10 8 For greater certainty, a Party may determine the point at which access to the international submarine cable system is to be provided.
