Interpret Trust and Plans. Specifically limit and define the individuals entitled to interpret the provisions of the Trust Agreement and any Plan adopted thereunder. The Trustees shall have the exclusive and discretionary right to interpret and construe the Trust document and the plan document of any plan or program established or administered by the Trust and to decide any and all matters arising thereunder, including the right to interpret plan terms and or remedy possible ambiguities, inequities, inconsistencies as well as to determine factual matters or omissions. All interpretations and decisions of the Trustees with respect to any matters hereunder shall be final, conclusive and binding on all parties affected thereby;

  • Captions and Interpretations Paragraph headings in this Agreement are used solely for convenience, and shall be wholly disregarded in the construction of this Agreement. No provision of this Agreement shall be interpreted for or against a party because that party or its legal representative drafted such provision, and this Agreement shall be construed as if jointly prepared by the Parties.

  • Clarifications and Interpretations It may be determined that clarifications or interpretations of the Contract Documents are necessary. Upon direction by the ODR such clarifications or interpretations will be provided by the A/E consistent with the intent of the Contract Documents.
