Plan Document. This Agreement and the Award are subject to all the provisions of the Plan, and to all interpretations, rules and regulations that may, from time to time, be adopted and promulgated by the Committee pursuant to the Plan. If there is any conflict between the provisions of this Agreement and the Plan, the provisions of the Plan will govern.
Plan Document. A copy of the entire plan document or the relevant portions of the plan document. For example, in a case involving an improper exclusion of eligible employees from a profit-sharing plan with a cash or deferred arrangement, relevant portions of the plan document include the eligibility, allocation, and cash or deferred arrangement provisions of the basic plan document (and the adoption agreement, if applicable), along with applicable definitions in the plan. If the plan is a 403(b) Plan and a plan document is not available, a written description of the plan should be submitted, with sample salary reduction agreements if relevant. In the case of a SEP and a SIMPLE IRA Plan, the entire plan document should be submitted.
Plan Document. This Agreement is subject in all respects to the Plan, a copy of which may be obtained from the Company’s Corporate Senior Vice President, Human Resources, 000 Xxxxxxxx Xxxxxx, Xxxxxxxxx, Xxx Xxxxxx 00000. To the extent that there is any inconsistency or conflict between this Agreement and the Plan, the Plan shall control.
Plan Document. This Adoption Agreement may only be used in conjunction with the Xxxxxxx Xxxxx Prototype Defined Contribution Plan and Trust Base Plan Document #03.
Plan Document. As provided above, this Agreement is entered into pursuant to the provisions of Section 3.9 of the Deferred Compensation Plan. The Participant has read and understands the terms and provisions thereof and hereof, and accepts the Award subject to all of the terms and conditions of the Plan and this Agreement. The Participant acknowledges that there may be adverse tax consequences upon the grant or vesting of the Award or disposition of the underlying shares and that the Participant has been advised to consult his or her tax advisor prior to such grant, vesting, or disposition.

By signing in the space provided below to acknowledge acceptance of this Award, Employee further acknowledges that Employee has received a plan summary which includes the text of the Plan and has been afforded an opportunity to ask any questions that he or she may have regarding the Plan or the rights granted hereunder.
Plan Document. In the event an active plan participant dies prior to satisfying the vesting requirements set forth in this Article, they will become 100% vested immediately for the buyout retirement plan benefit. The deceased Employee’s 401(a) buyout plan account shall be distributable to the decedent’s designated beneficiary or to his/her estate if no beneficiary designation has been made.
