Common use of Investment Portfolio Clause in Contracts

Investment Portfolio. Except for pledges to secure public and trust deposits or otherwise made in the ordinary course of business, Liens securing repurchase obligations incurred in the ordinary course of business consistent with past practice, and for FHLB stock, none of the investment securities reflected in the MBI Financial Statements and none of the investment securities since acquired by MBI or any of its Subsidiaries is subject to any restriction, whether contractual or statutory, which impairs the ability of MBI or any of its Subsidiaries to freely dispose of such investment at any time, other than those restrictions imposed on securities held to maturity under GAAP.
