Common use of Involuntary Bankruptcy Clause in Contracts

Involuntary Bankruptcy. There shall be filed against Company an involuntary petition or other pleading seeking the entry of a decree or order for relief under the Bankruptcy Code or any similar foreign, federal or state insolvency or similar laws ordering: (i) the liquidation of the Company; or (ii) a reorganization of Company or the business and affairs of Company; or (iii) the appointment of a receiver, liquidator, assignee, custodian, trustee, or similar official for Company of the property of Company, and the failure to have such petition or other pleading denied or dismissed within thirty (30) calendar days from the date of filing.

Involuntary Bankruptcy. There shall be filed against Company an involuntary petition or other pleading seeking the entry of a decree or order for relief under the Bankruptcy Code or any similar foreign, federal or state insolvency or similar laws ordering: (i) the liquidation of the Company; or (ii) a reorganization of Company or the business and affairs of Company; or (iii) the appointment of a receiver, liquidator, assignee, custodian, trustee, or similar official for Company of the property of Company, and the failure to have such petition or other pleading denied or dismissed within thirty ninety (3090) calendar days from the date of filing.

There shall be filed against any Company an involuntary petition pettition or other pleading seeking the entry of a decree or order for relief under the Bankruptcy Code or any similar foreign, federal or state insolvency or similar laws ordering: (i) the liquidation of the such Company; or (ii) a reorganization of such Company or the business and affairs of such Company; or (iii) the appointment of a receiver, liquidator, assignee, custodian, trustee, or similar official for such Company of the property of such Company, and the failure to have such petition or other pleading denied or dismissed within with in thirty (30) calendar days from the date of filing.

There shall be filed against Company Debtor an involuntary petition or other pleading seeking the entry of a decree or order for relief under the United States Bankruptcy Code or any similar foreign, federal or state insolvency or similar laws ordering: (ia) the liquidation of the Company; Debtor or (iib) a reorganization of Company Debtor or the business and affairs of Company; Debtor or (iiic) the appointment of a receiver, liquidator, assignee, custodian, trustee, or similar official for Company Debtor of the property of Company, Debtor and the failure to have such petition or other pleading denied or dismissed within thirty forty five (3045) calendar days from the date of filing.
