Irregularities of Supply. The Company may, from time to time, for the purposes of testing or for any other purposes connected with the efficient working of the supply of electricity, discontinue the supply at such intervals of time and for such purposes as it may deem expedient, provided always that save in case of emergency not less than twenty-four hours’ notice shall be given by the Company to all Consumers likely to be affected by such discontinuance. Provided that the Company has discharged its obligation under the Concessions Law to maintain in a safe condition and in all respects fit for supplying electricity all electric lines, service lines, fittings and apparatus belonging to it or under its control, and where possible has given the Consumer notice of the irregularity of supply, the Company shall not in any circumstances be held liable or responsible for any loss, damage or personal injury (including without limitation any loss of profits or indirect or consequential loss) arising as a result of any irregularities, interruptions or stoppages of the supply due to any cause (including without limitation malfunction of the Company’s equipment, accidents or Force Majeure). In the event of any such irregularity in supply the Company will use reasonable diligence to ensure that supply will be restored as soon as practicable.

  • VACANCIES AND PROMOTIONS Section 1. The following procedures will be followed in the posting and filling of vacant or newly created permanent positions. The purpose of this system is to inform employees of vacancies and newly created positions and to afford employees who are interested and who feel they qualify an equal opportunity to apply for the vacant or newly created position.   • Site to be free from Encumbrances Subject to the provisions of Clause 10.3, the Site shall be made available by the Authority to the Concessionaire pursuant hereto free from all Encumbrances and occupations and without the Concessionaire being required to make any payment to the Authority on account of any costs, compensation, expenses and charges for the acquisition and use of such Site for the duration of the Concession Period, except insofar as otherwise expressly provided in this Agreement. For the avoidance of doubt, it is agreed that existing rights of way, easements, privileges, liberties and appurtenances to the Licensed Premises shall not be deemed to be Encumbrances. It is further agreed that the Concessionaire accepts and undertakes to bear any and all risks arising out of the inadequacy or physical condition of the Site.

  • Defects a. The Customer shall inspect the Goods upon delivery and will, within 48 hours, notify the Company of any defects, short deliveries or any failure to fulfill any quotation or order.

  • Encumbrances Create, incur, assume or suffer to exist any Lien with respect to any of its property, or assign or otherwise convey any right to receive income, including the sale of any Accounts, or permit any of its Subsidiaries so to do, except for Permitted Liens.

  • VACANCIES AND JOB POSTINGS 17.01 When a job vacancy or vacancies occur within the bargaining unit and the Employer intends to fill the vacancy, the Employer will post an announcement of such vacancy or vacancies on all Union bulletin boards. Said postings shall remain posted for a period of five (5) working days. The announcement shall contain the job title of the vacancy, a brief job description and the rate of pay, and the date of the posting and bid deadline date.

  • Grievance Records All documents, communications, and records dealing with the processing of a grievance shall be filed separately from the personnel files of the participants.

  • Maintenance Records All maintenance work orders for the prior 12 months.
