Joint Drafting of Agreement. This Agreement has been prepared by the joint efforts of the respective counsel for each of the parties hereto and shall not be construed against a particular party simply by reason of such party being the drafting party.
Joint Drafting of Agreement. The Executive acknowledges that each party has cooperated in the drafting and preparation of this Agreement. Hence, in any construction or interpretation of this Agreement, the same shall not be construed against any party on the basis that the party was the drafter.

Joint Drafting of Agreement. Plainfield and Alpine acknowledge that no interpretation, presumption, or construction of this Agreement shall be based upon any party drafting this Agreement. Alpine and Plainfield acknowledge joint and mutual drafting of this Agreement.
Joint Drafting of Agreement. The Parties agree and stipulate that the settlement was negotiated on an “arm’s-length” basis between parties of equal bargaining power. The Agreement has been drafted jointly by Class Counsel and ERC’s counsel. Accordingly, this Agreement is mutually created, and no ambiguity shall be construed in favor of or against any of the Parties. This Agreement was prepared after an agreement in principle to resolve the case was reached after extensive negotiations between counsel and after a mediation with Retired United States District Court Magistrate Judge Xxxxxxx Xxxxxxxx.
Joint Drafting of Agreement. The Parties expressly agree that this Agreement was jointly drafted, and that both Parties had opportunity to negotiate terms and to obtain assistance of counsel in reviewing terms before execution. This Agreement shall be construed neither against nor in favor of either Party but shall be construed in a neutral manner.
