Judicial Settlement Sample Clauses

Judicial Settlement. The Master Custodial Administration Agreement Administrator shall have the right at any time to apply to a court of competent jurisdiction for judicial settlement of its accounts or for determination of any questions of construction which may arise or for instructions. The only necessary party defendant to any such action shall be the Participant and/or Plan Administrator, but the Master Custodial Administration Agreement Administrator may, if it so elects, join in as a party defendant any other person or persons. The cost, including attorneys’ fees, of any such accounting shall be charged to the Custodial Account as an administration expense of this Agreement.

Judicial Settlement. Nothing contained in the Trust shall be construed as depriving the Trustee or the Company of the right to have a judicial settlement of the Trustee's accounts. Upon any proceeding for a judicial settlement of the Trustee's accounts or for instructions the only necessary parties in addition to the Trustee shall be the Company and the Employee.

Judicial Settlement. Notwithstanding the foregoing the Trustee or the Company may apply at any time for a judicial settlement of the Trustee’s Account.

Judicial Settlement. The Trustees shall be entitled, at any time, to have a judicial settlement of their accounts and to seek judicial protection by any action or proceeding they determine necessary and, further, to obtain a judicial determination or declaratory judgment as to any question of construction of this Trust Agreement or for instructions as to any action thereunder, and, further, as to any questions relating to the discharge of their duties and obligations under, or in connection with the administration of, this Trust and as to the distribution of assets belonging to the Trust Fund. Any such determination, decision, or judgment shall be binding upon all parties to, or claiming under, this Trust Agreement.

Judicial Settlement. The Trustee or the Employer shall have the right to apply at any time to a court of competent jurisdiction for judicial settlement of any report of the Trustee not previously settled as hereinabove provided. In any such action or proceeding, it shall be necessary to join as parties only the Trustee and the Employer (although the Trustee may also join such other parties as it may deem appropriate), and any judgment or decree entered therein shall be conclusive on all persons having or claiming an interest in the Trust Fund.
