Common use of Jurisdiction and Divisions of Work Clause in Contracts

Jurisdiction and Divisions of Work. (a) The exclusive jurisdiction of the Union, as defined hereunder as “Bargaining Unit Work,” shall include all work in connection with and all Employees in the making, taking and servicing of motion and still pictures, whether on film, tape or film substitutes, and without restricting the generality of the foregoing, shall include all work of a kind and nature described herein. (b) The Company will not subcontract bargaining unit work which customarily and historically has been performed by Employees covered by this Agreement unless the Union consents thereto; or the Company lacks the requisite equipment, technology, facilities or personnel to perform the work; or the work of the type being subcontracted has heretofore been subcontracted by a producer engaged in the motion picture and television industry. When practicable, the Company shall deliver a minimum of one week’s advance notice to the Union of its intention to subcontract. (c) The job classifications contained in Schedule “A” shall not be changed or deleted, nor shall the jobs, or any duty of the job, be altered without the agreement of the Union. (d) Work not customarily performed by an Employee covered by this Agreement and work not included in the job classifications in Schedule “A” of this Agreement shall be performed by another Employee of the Company or by a person or corporation who is not an Employee of the Company. (e) The Local’s Heads of Departments shall be responsible for the building, striking, inspection, handling, placing and producing of sets, electrical equipment, properties, wardrobe, and the buying, renting or otherwise acquiring said properties, wardrobe or equipment as it applies to their area of duties and the Company agrees to employ sufficient personnel in every department so that each department is able to safely and efficiently complete its work. Each Department will have one Head at the applicable rate. It is agreed that the construction of flats falls under the jurisdiction of Local 873.
