No Sub-Contracting. The Company shall not contract nor sub-contract any Bargaining Unit Work and no person outside the bargaining unit shall perform Bargaining Unit Work.
No Sub-Contracting a. The Employer may not subcontract with third parties for the performance of work within the scope of this Agreement, unless the Employer determines that insufficient qualified Employees are available in the market or special skills or equipment is needed and cannot be supplied by the Union. Before subcontracting, the Employer shall give notice to the Union of such intended changes and the opportunity to discuss the situation before implementation.
b. The Employer shall inform the Union of subcontracting needs at least thirty (30) days before implementation or as soon as practicable if changes are to be made with less than thirty (30) days’ notice. Prior to implementing substantive changes in past practices with respect to staffing/xxxxxxx requirements or to subcontracting, the Employer shall give notice of such intended changes and the opportunity to discuss the situation prior to implementation. The requirements of this paragraph are not applicable to subcontracting caused by equipment limitations.
No Sub-Contracting. There shall be no sub-contracting of bargaining unit work unless mutually agreed upon. Sub- contracting does not include utilization of temporary agency personnel or service or special project contracts which does not result in the layoff or elimination of an entire department.
No Sub-Contracting. EXCLUDING the small and/or remote locations classified in the Motor Carrier Industry as Commission Agencies or classified in the Teamsters Master Freight Agreement as Working Agents: No normal terminal office work which would normally be performed by Employees within the bargaining unit as covered in this Agreement, shall be sub- contracted to or through employment agencies or other such sundry types overload agencies or to an individual.
No Sub-Contracting. Unless prior and specific written consent is obtained from the MIDAS Contact to the contrary, the Supplier shall not sub-contract delivery of any of the Services or any of its other obligations under the Framework Agreement and shall perform the same personally and shall not assign or transfer any of its rights or obligations under the Framework Agreement.
No Sub-Contracting. The Union recognizes that contracting out work normally performed by bargaining unit employees is a right of the District. The District and Union share the belief that we can best serve the needs of our students when we have highly trained, effective and supportive employees. This belief is strengthened by the collaborative relationship between the Union, its members, and the District. Therefore, the District and Union agree that for the duration of this contract the District will not engage in any consideration of subcontracting for positions covered under this Agreement. No Sub-Contracting. (a) No party may assign its interest in this Agreement without the consent of the other party, except that Rinnai may assign or novate its interest in this Agreement to any Rinnai company within the Rinnai group of companies.
(b) The Seller may only sub-‐contract its manufacturing obligations under this Agreement with the prior written consent of Rinnai.
(c) The Seller must ensure that any sub-‐contractor approved by Rinnai observes all the provisions of this Agreement as if the sub-‐contractor were a party to this Agreement. The Seller indemnifies Rinnai for the acts, defaults and omissions of its sub-‐contractors as if they were those of the Seller. Approval to sub-‐contract shall not relieve the Seller from any liability or obligation under this Agreement.
No Sub-Contracting. Because the Xxxxxx’ expertise and knowledge is unique, all Services shall be performed by the Xxxxxx alone, and Consultant may not sub-contract any work under this Agreement.
No Sub-Contracting. Except as expressly provided in this Agreement, the Host School must not sub-contract to any third person any of its obligations under this Agreement without the prior written consent of the Purchasing School, which consent will not be unreasonably withheld. The Host School may seek the Purchasing School's consent to sub-contract by using the form in Schedule 5. The Host School will not, as a result of any sub-contracting arrangement, be relieved from the performance of any obligation under this Agreement and will be liable for all acts and omissions of a sub-contractor as though they were the actions of the Host School itself.
