(d) Provide a Television License whether or not he supplies a televisionThe Property is compliant with The Smoke and Carbon Monoxide Alarm (England) Regulations 2015 at the start of the Tenancy.

4.2 at all times during the Term to maintain and keep in good and substantial repair and condition:-

4.4 Not to interfere with or cause or permit or suffer any interference with any Electrical Plant apparatus equipment the Electric Lines or other works installed constructed or laid by the Tenant (or the DNO) in on under or over the Property or in the Ducts nor to interfere with or obstruct or permit or suffer to be interfered with or obstructed the free flow of air to and from and through the louvered ventilators within the Property and in particular not to place or stack or permit or suffer to be placed or stacked anything near the doors to the Property so as to block obstruct or prevent the free opening of them.
4.5 not to remove alter or cut through or permit and suffer to be removed altered or cut through the walls bounding or the ceiling over the Property or the floor of the Property or any part or parts of them.
4.6 Not to do permit or suffer to be done anything which will interfere or in any way reduce the rights of support shelter and protection specified in paragraph 6 of the Second Schedule Part 2 (Tenants Rights) and in particular not to do permit or suffer to be done anything by which the floor of the Property shall in any way be rendered unstable or unsafe or incapable of bearing the weight of the Tenant’s Electrical Plant apparatus or equipment the Electric Lines or other works installed in on or around the Property.
4.7 that the Tenant paying the rent hereby reserved shall and may peaceably and quietly hold and enjoy the Property together with the Rights during the Term without any interruption or disturbance from or by the Landlord agrees its successors in title or any person or persons claiming by through or in trust for it;
4.8 that it will not do or permit anything to be done in or upon the Landlord’s Adjoining Land which shall or may impede or interfere with the exercise by the Tenant or the DNO of the Rights or cause damage to or endanger or interfere with the Electric Lines or cause any leakage of electricity from the Electric Lines;
4.9 not to alter, permit or suffer to be altered the existing level of nor to cover or permit to be covered the surface of the Electric Lines in such manner so as to render the laying or the free access thereto impracticable, difficult or materially more expensive than as at the date of this Lease PROVIDED THAT nothing in this covenant shall prevent the laying or re-laying of appropriate surfaces on any part of the Accessway as is intended to form part of a road or footpath after the initial laying of the Electric Lines;
4.10 to indemnify the Tenant and separately the DNO against all actions, proceedings, costs, claims, losses, damages, expenses and liability incurred threatened or caused by any contamination or pollution (as defined by the Environment Protection Act 1990) created before or existing on the date hereof on and/or affecting the Property and/or the route of any Electric Lines installed pursuant to the Rights and the cost of all remedial action carried out in the future in respect of such past contamination or pollution and professional fees and expenses in connection with all such matters;
4.11 to keep the Tenant and, separately, the DNO indemnified from and against all costs, charges and expenses incurred or hereafter to be incurred in respect of the making up completion and adoption of the Estate Roads (and any sewers thereunder) for and until adoption of the same by the appropriate authorities;
4.12 to promptly carry out all the obligations imposed on the Landlord by virtue of any agreement entered into with the local planning and highway authorities as a condition of or in consequence of the grant of any planning permission affecting the Landlord’s Adjoining Land in so far as these obligations affect the Property and/or the Rights, and to indemnify the Tenant, and separately the DNO, in respect of any breach or non performance of them;
4.13 not without the prior written consent of the Tenant and, separately of the DNO to:
4.13.1 permit the erection or extension of any building, wall, fence or other structure (save for any that are shown on the Plan) to be so constructed or placed; or
4.13.2 to allow any tree shrub or xxxxxxxxx to grow so as to become within 1.5 metres of the Electric Lines and provided always that where consent is given the provisions of the Electricity, Safety, Quality and Continuity Regulations 2002 (as amended from time to time) shall be complied with;
4.14 to insure the Property, Building (including the Substation) with such substantial insurance office and for such sum as the Landlord shall from time to its time be advised as being the full value, providing a copy cost of the insurance cover reinstatement thereof including professional fees payable on any application for planning permission or other consent as may be required the cost of removal demolition site clearance and any works that may be incidental to that against damage or destruction by fire riot civil commotion malicious damage storm flood bursting and overflowing of water pipes and other apparatus and such other risks as may be usual to insure against (the ”Insured Risks”).
4.15 if and whenever during the Term the Building and/or the Substation or any part of it is damaged or destroyed by any of the Insured Risks the Landlord shall following receipt of all appropriate consents and to the extent that the insurance monies are not withheld as a result of any act or default of the Tenant if requested.

The Landlord will ensure that all damage caused to an insured risk is remedied rebuild and reinstate the part of the Building housing the Substation (and including the Substation) as soon as possible under the insurance policy, unless the damage has been caused by the wilful actions or negligence and will apply all money received in respect of the Tenant.

8.8 The Landlord shall pay and carry on paying throughout the Term any mortgage or loan payments payable by the Landlord on the Property in a Television License whether or not he supplies a televisiontimely manner.
8.9 Should the Landlord fail to comply with ‘The Landlord’s covenant’s’ of this lease, the tenant will be entitled to terminate this lease without notice and give back the property to the landlord.

LANDLORD'S COVENANTS. (A) LANDLORD’S COVENANTS DURING THE TERM: Landlord covenants during the Term:
12.1. The Landlord agrees to provide (1) To furnish, through Landlord’s employees or independent contractors, the Tenant with suitable means of access and egress to and from the Property. XXXXXXXXXX LETTINGSservices listed in Exhibit D; and

12.4. The Landlord agrees that Americans with Disabilities Act upon the Tenants paying Commencement Date, and Landlord shall be responsible for maintaining said entrances and exits in compliance during the rent and performing and observing their covenants to allow Term. Landlord represents that the Tenant quiet enjoyment Property is not in violation of applicable zoning regulations. Landlord has received no notice of any noncompliance of the Property and with Massachusetts General Laws, Chapter 2lE or the Department of Environmental Protection’s Massachusetts Contingency Plan and, to avoid unreasonable interruptionthe best of Landlord’s knowledge, the buildings contain no asbestos or other hazardous materials.
12.5(4) Landlord will keep the buildings and other structures (including all alterations, additions, and changes thereto to the extent made by Landlord) which are located within the Lot, insured under an all risks property insurance policy (not excluding from coverage perils normally included within the definitions of extended coverage, vandalism and malicious mischief, earthquake and flood), in the amount of one hundred percent (100%) of the replacement value of the base buildings (excluding Tenant’s improvements), with endorsements for contingent liability from operation of building laws, increased costs of construction, and demolition costs which may be necessary to comply with building laws. The insurance required hereby shall be written by a company authorized to do business in the state of the location of the demised premises. Landlord will be responsible for determining the amount of property insurance to be maintained, but such coverage will be on an agreed value basis to eliminate the effects of co-insurance. Landlord will provide to Tenant a certificate from Landlord’s insurer evidencing the coverage required under this lease, which certificate will include the waiver of subrogation. Landlord shall also maintain from and after the date of this lease and throughout the lease Term, commercial general liability insurance on an occurrence basis against claims on account of bodily injury, death or property damage incurred upon any part of the demised premises. Such insurance policy will have combined single limits of not less than Two Million Dollars ($2,000,000.00) per occurrence and provide contractual coverage of Landlord’s liability to Tenant assumed under the indemnification provision under this lease. The insurance required hereby shall be written by a company authorized to do business in the state of the location of the demised premises. Landlord will provide to Tenant a certificate from Landlord’s insurer evidencing the coverage required under this lease. Insurance against any or all of such risks may be maintained under a blanket policy covering the demised premises and other real estate of Landlord and/or its affiliated business organizations provided the demised premises is specifically scheduled. Said policies may contain sublimits on earthquake and flood insurance. The proceeds of Landlord’s property insurance in case of loss or damage will be applied on account of the obligation of Landlord to repair and/or rebuild the damaged or destroyed buildings (but excluding Tenant’s improvements) in accordance with Article VIII of this lease provided, however, that Landlord may rebuild the buildings with a block structure, and not brick structure. Tenant agrees to carry out all repairs pay to Landlord, as additional rent and as part of Operating Expenses, the cost to Landlord of keeping the demised premises insured as hereinabove provided.
(B) INTERRUPTIONS Landlord shall not be liable to Tenant for which it is responsible under section 11 any compensation or reduction of the LTA 1985 namely:
rent by reason of inconvenience or annoyance or for loss of business arising from (a) To keep in repair the structure and exterior of the dwelling-house (including drainspower losses or shortages, gutters and external pipes),
or (b) To keep the necessity of Landlord’s entering the demised premises for any of the purposes in repair and proper working order this lease authorized, including without limitation, for repairing or altering the installations demised premises or any portion of the Building or for bringing materials into and/or through the demised premises in connection with the making of repairs or alterations. In case Landlord is prevented or delayed from making any repairs, alterations or improvements or furnishing any service or performing any other covenant or duty to be performed on Landlord’s part, by reason of any cause reasonably beyond Landlord’s control, Landlord shall not be liable to Tenant therefor, nor, except as expressly otherwise provided in Article VIII, shall Tenant be entitled to any abatement or reduction of rent by reason thereof, nor shall the same give rise to a claim in Tenant’s favor that such failure constitutes actual or constructive, total or partial, eviction from the demised premises. Landlord reserves the right to stop any service or utility system when necessary in Landlord’s reasonable opinion by reason of accident or emergency or until necessary repairs have been completed. Except in case of emergency repairs, Landlord will give Tenant reasonable advance notice (but in any event not less than forty eight (48) hours) of any contemplated stoppage and, in any event, Landlord will use reasonable efforts to avoid unnecessary inconvenience to Tenant by reason thereof. Notwithstanding anything in this Section (B) of Article IV to the contrary, in the dwelling-house for the supply of water, gas event any such disruption to Tenant’s operations and electricity and for sanitation (including basins, sinks, baths and sanitary conveniences, but not other fixtures, fittings and appliances for making use of the supply of waterdemised premises is attributable to Landlord’s negligence, gas or electricity), and
(c) To keep in repair and proper working order the installations in the dwelling house for space heating and heating water.
(d) To keep in good repair the appliances that are supplied under within the property.
12.6. The Landlord will not be required:
(a) To carry out works or repairs for which the Tenant is liable by virtue of its duty to use the premises in a tenant-like manneragents, contractors, servants or employees, or would be so liable but is attributable to a breach by Landlord of its obligations under this lease, and if such disruption shall materially impair Tenant’s use of the demised premises for an express covenant on its part,
a period in excess of five (b5) To rebuild or reinstate business days in duration, then a just proportion of the Rent, according to the nature and extent of the impairment to Tenant’s operation and use of the demised premises in the case shall xxxxx for any such period of destruction or damage by fire, or by tempest, flood or other inevitable accident,
