Tenant’s quiet enjoyment. Upon the Tenant paying the Rent and all other monies payable under this Agreement, and observing and performing the Tenant’s covenants and obligations under this Agreement, the Tenant shall peaceably hold and enjoy the possession of the Premises during the Term without disturbance by the Landlord or any person rightfully claiming under or in trust for the Landlord.

Tenant’s quiet enjoyment. Subject to the terms of this Lease, and so long as Tenant is not in default, Tenant may peacefully and quietly have, hold and enjoy the Apartment for the term of the Lease. Tenant acknowledges that it is not a breach of this Lease by Landlord if other Tenants disturb or disrupt other Tenants or persons.
Tenant’s quiet enjoyment. Upon the written request of the Borrower, the Administrative Agent shall deliver a subordination, non-disturbance and attornment agreement, in favor of the lessee under any lease of Real Property Assets, in form and substance reasonably satisfactory to the Administrative Agent and the Borrower, pursuant to which agreement the Administrative Agent shall agree (to the extent required by the applicable lease or sublease) (a) to give the tenant or subtenant thereunder the same notice, if any, given to the Borrower of any default or acceleration of any obligation underlying the applicable Mortgage or any sale in foreclosure under such Mortgage, (b) to permit the tenant or subtenant thereunder to cure any such default on the Borrower's behalf within any applicable cure period, (c) to permit the tenant or subtenant thereunder to appear by its representative and to bid at any sale in foreclosure made with respect to the applicable Mortgage and (d) subject to the terms to be included in the applicable subordination, non-disturbance and attornment agreement, not to disturb the aforesaid tenant's or subtenant's possession so long as it is not in default in performing its obligations under such lease or sublease.

Tenant’s quiet enjoyment. LANDLORD agrees that so long as TENANT faithfully did and diligently performs all of its obligations under this Lease Agreement, it may peaceably and quietly hold and enjoy the Leased Premises during either the Initial or the Extended Term without any manner of molestation or hindrance by LANDLORD or by anyone claiming by, through or under LANDLORD.
