Common use of Laws and Limitations Clause in Contracts

Laws and Limitations. The Employer on its own behalf and on the behalf of the electors of the College, retains and reserves unto itself, without limitation, all rights, powers, authorities, duties and responsibilities conferred upon and invested in it by the laws and constitutions of the State of Michigan and the United States, including the right to select and hire, to promote to better position, to maintain discipline and efficiency of employees, and the right to discharge, voluntary transfer or discipline non- probationary employees for just cause is recognized by both the Union and the Employer as the proper responsibility and prerogative of management, providing it does not violate this Agreement.
