LD for Delay in Commissioning. (a) If the Commercial Operation Date of the Project has not occurred by the Required Commercial Operation Date and such date has not been extended in accordance with this Contract by the Parties or as a consequence of a Force Majeure Event or Political Event or Change in Law and the delay is attributable to the Company, the Company shall pay to BPDB as liquidated damages for delays in Commissioning equal to USD 50 (fifty) per MW per day or fraction thereof.
